Como produto da prática mercantil, a cláusula da nação mais favorecida (CNMF) é um fenômeno jurídico complexo. Enquanto sua estrutura variante não é passível de padronização, por se adaptar às necessidades da sociedade internacional em cada momento histórico, seu núcleo funcional permanece imutável. Na ordem econômica internacional, a descentralização do poder político provoca desconfianças nos agentes econômicos, resultando em um permanente estado de guarda e competitividade predatória. Nas últimas décadas, a importância da normalização técnica para comércio internacional aumentou consideravelmente. Segundo dados da OCDE, estima-se que um total de 80% do comércio global na atualidade seja afetado por normas e regulamentos técnicos. Esse cenário justifica a preocupação dos Membros da OMC em incentivar o estabelecimento de padrões tecnológicos comuns nos diversos países, como um instrumento para evitar o incremento das barreiras técnicas e promover a facilitação do fluxo internacional de bens, serviços, investimentos e tecnologias. Contudo, o crescente envolvimento de direitos de propriedade intelectual nas normas técnicas internacionais tem preocupado algumas nações, principalmente em decorrência dos elevados custos, tensões e conflitos que resultam dessa situação, impactando de forma negativa o comércio. O Laboratório de Metrologia Nuclear (LMN) do Instituto de Pesquisas Energéticas e Nucleares (IPEN) desenvolveu recentemente o Sistema de Coincidência por Software (SCS), para a digitalização e registro dos sinais de seus sistemas de coincidências 4πβ-γ utilizados na padronização de radionuclídeos. O sistema SCS possui quatro entradas analógicas independentes que possibilitam o registro simultâneo dos sinais de até quatro detectores (vias β e γ). A análise dos dados é realizada a posteriori, por software, incluindo discriminação de amplitudes, simulação do tempo-morto da medida e definição do tempo de resolução de coincidências. O software então instalado junto ao SCS estabeleceu a metodologia básica de análise, aplicável a radionuclídeos com decaimento simples, como o 60Co. O presente trabalho amplia a metodologia de análise de dados obtidos com o SCS, de modo a possibilitar o uso de detectores com alta resolução em energia (HPGe), para padronização de radionuclídeos com decaimentos mais complexos, com diferentes ramos de decaimento ou com transições metaestáveis. The project in hands was developed in order to distinguish which topics can be of interest when studying methods for improvement on the link between R&D and the manufacturing process. Doing so, it also aims to prove that through standardization processes it is possible a fastest and smoother dislocation to international markets and, consequently, achieve competitive advantages in those same markets with different conditions from the home market. To do so, a qualitative analysis of a company in the footwear business was taken into consideration to better understand the difficulties in the multinational context of a manufacturing company. Surveillance of group A streptococcal (GAS) infections was undertaken as a major component of the European Commission-funded project on severe GAS disease in Europe (strep-EURO). One aim of strep-EURO was to improve the quality of GAS characterization by standardization of methods. An external quality assurance study (EQA) was therefore carried out to evaluate current global performance. Eleven strep-EURO and seven other streptococcal reference centers received a panel of 20 coded GAS isolates for typing. Conventional phenotypic typing (based on cell surface T and M protein antigens and opacity factor [OF] production) and molecular methods (emm gene typing) were used either as single or combined approaches to GAS typing. T typing was performed by 16 centers; 12 centers found one or more of the 20 strains nontypeable (typeability, 89%), and 11 centers reported at least one incorrect result (concordance, 93%). The 10 centers that tested for OF production achieved 96% concordance. Limited availability of antisera resulted in poor typeability values from the four centers that performed phenotypic M typing (41%), three of which also performed anti-OF typing (typeability, 63%); however, concordance was high for both M (100%) and anti-OF (94%) typing. Gene expression profiling has the potential to enhance current methods for the diagnosis of haematological malignancies. Here, we present data on 204 analyses from an international standardization programme that was conducted in 11 laboratories as a prephase to the Microarray Innovations in LEukemia (MILE) study. Each laboratory prepared two cell line samples, together with three replicate leukaemia patient lysates in two distinct stages: (i) a 5-d course of protocol training, and (ii) independent proficiency testing. Unsupervised, supervised, and r2 correlation analyses demonstrated that microarray analysis can be performed with remarkably high intra-laboratory reproducibility and with comparable quality and reliability.

Case reports comprise the core of Journal of Medical Case Reports, are a time-honored tradition firmly established within the medical literature, and represent a growing importance of valuable clinical medical information in our modern information-flowing times. While there is already a body of published literature on how and when to write a case report and both Journal of Medical Case Reports and BioMed Central make known their own criteria, case report quality across all of the medical literature is still variable. Additionally, although health reporting agencies do have standardization guidelines for other aspects of health-care reporting, there has never been an organizational body responsible for international standardization of how to write a case report. With the newly-published CARE (CAse REport) guidelines, Gagnier and colleagues hope to change this. This editorial serves as a brief introduction to the CARE guidelines and briefly examines the proposed standardization of case reports. We invite feedback on the CARE guidelines from all of our readers and encourage their trial run implementation by our own case report authors.

This article will discuss the main mechanisms by which the United States and other countries are attempting to standardize their pharmaceutical regulations. I first explore the need for standardization and the potential benefits that standardization offers. Then I sketch the early efforts of nations to move toward standardization. I present and critique the mechanisms by which standardization is currently proceeding and the progress that has been made to date. I also detail the Food and Drug Administration’s (FDA) participation in international standardization. I argue that reform of the standardization process is necessary to reap the full benefits of standardization. Specifically, the various tools of standardization, the ICH, MRAs, and MOUs need to be integrated so as not to work at cross-purposes. The standardization process must be expanded to account for the views of consumers and non-member nations. Most importantly, in the absence of a way to bind nations to commitments to standardize pharmaceutical regulations, standardization mechanism are in danger of becoming another layer of regulatory delay; to avoid this pitfall, standardization agreements must be made enforceable.

In the article on “Standardization” in the 14th edition of the Encyclopædia Britannica, Paul Gough Agnew, the long-time Secretary of the American Standards Association (ASA), argued: In the flow of products from farm, forest, mine, and sea through processing and fabricating plants, and through wholesale and retail markets to the ultimate consumer, most difficulties are met at the transition points––points at which the product passes from department to department within a company, or is sold by one company to another or to an individual. ISTA - International Seed Testing Association, founded in 1924 aiming to develop and publish standard procedures in the field of seed testing, is a non-profit association of public and private seed testing laboratories and persons under the Governance of the Government of member countries. ISTA works to achieve reproducibility in seed quality determination on a worldwide basis. Currently there are 58 countries with at least one ISTA accredited laboratory. The number of member laboratories is 211 from which 123 are accredited ones. The goals of ISTA are international standardization of: reporting results (Orange Certificate); methodologies for testing seeds (Rules), laboratory performance (Accreditation Programme) and international exchange of scientific results (Journal of Seed Science and Technology, Seed Symposiums and Seed Seminars). Since 1933 ISTA has published the International Rules for Testing Seeds. The ISTA Rules can be modified and amended annually by members and non-members, public and private laboratories or persons working in the area of seed science and technology during ISTA Annual Meeting held every year in a different country. The present document is the assessment of the systemically important payment systems in the Kingdom of Saudi Arabia (KSA) based on the CPSS Core Principles for Systemically Important Payment Systems (CPSIPS). The document also contains an analysis of some developmental issues related to the reform of the payments system as a whole. The assessment was conducted in the context of the field mission of the Financial Sector Assessment Program (FSAP) Update to the KSA (April 2011). The assessor of the CPSIPS was Massimo Cirasino. Without transport there is no economic development and, in a reciprocal conclusion, the more efficient transport is, the better is the development. Bearing in mind that more than 90 percent of the world trade in tons per year is transported by sea and against the background of increasing ship sizes (especially in the container trade) and continuously growing globalization, the requirements for adequate and secure port facilities and the resulting logistics challenges are accelerating worldwide. The International Ship and Port Facility Security Code (ISPS code) is a comprehensive set of measures to enhance the security of ships and port facilities and came into force on the July 1, 2004. The ISPS code is implemented through chapter XI-2 special measures to enhance maritime security in the International Convention for the Safety of Life at Sea (SOLAS). The code has two parts, one mandatory (part A) and one recommendatory (part B). Continuous innovation and a growing consumer demand for better and safer products has led to an increase of transnational technical standard-setting in recent years. The World Trade Organization (WTO) exercises a high level of deference towards international standards, requiring their use. However, practice shows that several international standards are adopted through opaque and exclusionary processes. In line with this observation, in its recent US – Tuna II ruling, the Appellate Body adopted a more critical approach regarding international standards and the processes that lead to their adoption. Against this backdrop, this paper focuses on an analysis of the properties and mechanics of international standard-setting processes within the International Organization for Standardization (ISO), discussing procedural and substantive guarantees regarding transparency, openness, deliberation and participation. As the WTO becomes the de facto arbiter of the legitimacy of international standards, much-needed institutional reform in international standard-setting is bound to occur, in line with emerging demands for a more inclusive global legal order.

The Common Agricultural Policy (CAP) of the EU required a large amount of GI data in order to manage area-based subsidies for the European farmers. The Land Parcel Identification Systems (LPIS) are established in all MS as a state register and evidence a new kind of land management in the agricultural sector. The aim of this paper is twofold: (i) to study institutional requirements of the EU regulatory framework and (ii) to introduce the framework of conceptual modelling and methodological approaches for standardisation in this sector domain. This paper addresses the recent challenges for LPIS geographic data, such as operating within a Spatial Data Infrastructure (SDI) and its requirements for data harmonisation and interoperability. The core LPIS Conceptual Model (LCM) that represents conceptual compliance with the EU regulations is introduced. The first-cut LCM described in this paper is the initial step on the way to standardization in the IACS Spatial Data Interest Community (Devos et al, 2007). The LCM is generated by means of both (i) methodological approaches of International Standards of ISO 19100 series and the INSPIRE principles and (ii) reverse engineering of existing operational systems. Com a redução das barreiras tarifárias ao comércio internacional, as normas técnicas, regulamentos técnicos e procedimentos de avaliação da conformidade vêm se tornando importantes mecanismos protecionistas e de restrição ao comércio. Esse trabalho tem por objetivo estudar essas questões, tendo como foco principal a exportação para a União Européia dos equipamentos eletromédicos produzidos por pequenas e médias empresas brasileiras. Realiza-se uma revisão bibliográfica buscando-se identificar e comparar as normas técnicas, os regulamentos técnicos e os mecanismos de avaliação da conformidade para os dispositivos eletromédicos, praticados pela União Européia e os vigentes no Brasil. É desenvolvida uma pesquisa junto a PMEs Pequenas e Médias Empresas fabricantes de dispositivos eletromédicos e exportadores para a União Européia, buscando-se identificar as dificuldades encontradas, as formas de superação dessas e os apoios recebidos. The influence of adaptation and standardization of the marketing mix on performance: a meta-analysis

This article analyzes the relationship between strategies of standardization and adaptation of the marketing mix and performance in an international context. We carried out a meta-analysis on a sample of 23 studies published between 1992 and 2010. The sample was analyzed based on measures of the effect size (ES) - or the strength of the relation (Wolf, 1986) - between standardization/adaptation and performance. The results suggest the existence of a medium strength (ES ranging from .133 to .209) for the relationship considered. The results support the existence of a positive impact of both marketing mix adaptation and standardization on performance. However, our results suggest that companies should slightly emphasize the marketing mix adaptation (ES mean = .168) instead of standardizing it (ES mean = .134) when entering in a new international market. Results also indicate that, among the adaptation choices, price (ES = .209) should be the first element of the marketing mix to be adapted, followed by promotion (ES = .155), product (ES = .154), and distribution (ES = .141). The paper presents a summary of those aspects that can influence on the shallow and very shallow water environment where many of the wind farms are located. As a first result the experience shows the important influence of the installation and decommissioning phases while the normal running activity has a much smaller impact on mammals and other fauna. Results are given with respect to European waters mainly. These results refer to the frequency content, the time duration, the peak and lowest levels to expect and the interaction with the background noise. The knowledge of this set of data should be added to others from many different sites to form a data base that can become important in front of any future standardization.; Peer reviewed

Resumo:Reestruturar e adaptar o Modelo de Avaliação para Periódicos Científicos On-line. Fundamenta-se nas normas da International Organization for Standardization (ISO), tais sejam: ISO 9707/1991, ISO 20983/2003, ISO 8/1977 e ISO 215/1986. Especifica as variáveis das normas ISO que foram adaptadas e incluídas no Modelo, composto por nove critérios e 85 indicadores. Aplica o modelo em 17 periódicos científicos on-line da área de Biblioteconomia e Ciência da Informação. Analisa e discute os resultados para cada critério do Modelo e constata que os periódicos científicos on-line avaliados estão parcialmente normalizados. Conclui que os resultados obtidos poderão contribuir para a padronização e a recuperação dos periódicos científicos brasileiros e que os mesmos são preliminares, já que fazem parte de pesquisas em andamento, as quais visam à validação do Modelo em outras áreas do conhecimento. OBJECTIVE: To identify gaps in the systems for reporting adverse events following immunization (AEFI) in Europe by means of an interactive database constructed using a standardized approach. METHODS: A comparative survey was conducted in 1999-2000, using structured questionnaires addressed to the government authorities responsible for national immunization programmes and drug safety surveillance in all European Union (EU) Member States and in Norway and Switzerland. FINDINGS: The reporting of adverse vaccine reactions (AVRs) is covered by regulations in 13 of the 17 countries. Four countries have a specialized expert group with responsibility for vaccine safety. Only six professionals work full-time on vaccine safety in the 17 countries; in four of these countries the person is medically qualified. Fourteen countries have centralized reporting systems; in 14 countries the responsible authority is the drug regulatory agency. AEFI are reported using the procedure used for adverse drug reactions (ADRs) in all except four countries. The reporting form is not usually designed for vaccines and important details may therefore not be requested. Clinical definitions for vaccine reactions are not available.
