Introdução: A psicopatia sempre foi associada a comportamentos imorais e frieza emocional, além de risco de reincidência criminal. Embora a frieza dos psicopatas seja bem estabelecida, não há consenso sobre o nível de discernimento moral desses indivíduos, existindo teorias propondo que eles não apresentam desenvolvimento moral adequado enquanto outras propõem que o que lhes falta é querer agir, não saber discernir o certo do errado. Já quando analisamos a relação entre essas três variáveis, psicopatia, imoralidade e frieza, os dados são ainda mais díspares, não existindo consenso sobre a necessidade ou não da presença de emoções para o amadurecimento moral. O estudo de sujeitos infratores encarcerados é interessante nesse contexto, uma vez que permite o controle de variáveis de confusão envolvidas nessa inter-relação, como influências ambientais, vivência criminal, grau de psicopatia, uso de drogas e QI. O tráfico de drogas é reconhecido pela Saúde Pública como um dos principaisfatores de risco e de vulnerabilidade a que os jovens brasileiros são expostos desde,pelo menos, a década de 1980. Este estudo objetiva descrever e analisar a vidacotidiana de jovens (de 15 a 29 anos) moradores de bairros periféricos de São Paulo,em que há a coincidência entre o comércio varejista de drogas feito em suas ruas,relações comuns de vizinhança e ações combinadas e intensivas das forças derepressão, aliadas às de assistência e às de atenção governamentais. Face à carência de estudos de psicodrama com jovens delinquentes, a presente tese tem como objetivo estudar a eficácia deste modelo terapêutico com um jovem, entre os 14 e 18 anos, que esteja a cumprir uma medida tutelar educativa de acompanhamento educativo. Foi escolhida como metodologia o Hermeneutic Single Case Efficacy Design (Elliott, 2002) por permitir uma avaliação mais minuciosa e rigorosa das mudanças que ocorrem ao longo do processo terapêutico, tendo em conta a sua eficácia e eficiência, e a análise do processo de mudança. Propomo-nos a refletir sobre a adequação e efeito do psicodrama em jovens delinquentes, tendo em conta, entre outros: que a dramatização psicodramática é útil para indivíduos com dificuldades de verbalização, sendo esta devido ao seu temperamento, educação e/ou cultura (Blatner, 2000). The Canadian Paediatric Society is deeply concerned about the negative effects on the developmental, psychological and emotional health of young offenders if the Youth Criminal Justice Act is amended as proposed. Changing Canada’s youth crime law to achieve stiffer sentences for youth 14 years of age and older who are convicted of serious violent offences is contrary to the United Nations Convention on the Rights of the Child. Treating adolescents as adults puts them at serious health and human rights risks – including trauma, violence and abuse – and interferes with their overall development. Furthermore, rates of mental illness are higher among youth in custody. Youth should only serve their sentence in a facility that is exclusively limited to youth, and considers the rights of youth as well as their mental, physical, developmental and educational needs.

O objetivo desse estudo foi investigar as avalia????es que os adolescentes em conflito com a lei fazem sobre o cometimento do delito, a medida socioeducativa e as perspectivas futuras. Os dados foram coletados por meio dos prontu??rios dos internos e de entrevistas semiestruturadas realizadas com nove adolescentes que cumpriam medida de interna????o em um centro de atendimento socioeducativo. Os resultados retrataram um perfil permeado por pobreza, baixa escolaridade, falta de rede familiar, uso de drogas e reitera????es nos delitos. La Loi sur le système de justice pénale pour les adolescents est récente en matière de justice des mineurs. Sa mise en vigueur en avril 2003 a précisé et changé les critères de la détermination de la peine. Le présent mémoire vise à mieux cerner ce sur quoi les juges se fondent pour prendre leurs décisions. À cette fin, une analyse de la jurisprudence disponible ainsi que des entrevues avec des juges oeuvrant à la chambre de la jeunesse de Montréal ont été effectuées. L’application des dispositions relatives aux objectifs et aux principes propres à la détermination de la peine a suscité des commentaires de la part des juges et des difficultés ont été soulevées. Des balises ont également été établies par les juges dans le cadre de leur pratique. Ils les suivent pour déterminer les peines. Il en ressort que le système de justice pour mineurs se rapproche du système de justice pour adultes, dont les interventions sont davantage centrées sur l’infraction que sur l’infracteur. Depuis plus d’une décennie, le Centre jeunesse de Montréal-Institut universitaire préconise l’utilisation de l’approche cognitive-comportementale à la Direction des Services Spécialisés et des Services aux Jeunes Contrevenants, celle-ci ayant démontré son efficacité auprès des jeunes soumis à la Loi sur le système de justice pénale pour les adolescents. Un des objectifs généraux de cette approche est de favoriser l’acquisition de nouveaux comportements prosociaux et la généralisation de ceux-ci dans le milieu naturel dans le but de protéger la société et de prévenir la récidive de l’adolescent. Ce mémoire de maîtrise cherche à jeter un regard approfondi sur les cas des jeunes contrevenants référés au processus de médiation à Trajet, un organisme de justice alternative à Montréal. Plus précisément, les objectifs sont de décrire les caractéristiques des cas référés, d’explorer leur relation avec la participation au processus de médiation et avec le résultat de celui-ci, et de comparer ces mêmes éléments en regard de deux périodes inclues dans le projet : celle où s’appliquait la Loi sur les jeunes contrevenants et celle où la Loi sur le système de justice pénale pour les adolescents assortie de l’Entente cadre sont entrés en vigueur. Des méthodes de recherche quantitatives ont été utilisées pour analyser les cas référés à Trajet sur une période de 10 ans (1999-2009). Dans le cadre du Programme de suivi intensif différencié du Centre jeunesse de Montréal — Institut universitaire, les intervenants composent au quotidien avec de jeunes contrevenants qui présentent des comportements agressifs. En effet, les jeunes faisant l’objet d’une ordonnance en vertu de la Loi sur le système de justice pénale pour les adolescents qui présentent une forte capacité criminelle et une faible capacité sociale sont orientés vers ce programme. Ce rapport s’attarde aux comportements agressifs des jeunes ainsi qu’aux facteurs qui les entourent et qui permettent de mieux les comprendre. Suite à une recension des écrits portant sur les théories de l’agressivité, ses différents facteurs de risque et de protection ainsi que ses manifestations, une analyse de contenu de trois dossiers de jeunes contrevenants présentant des comportements d’agressivité a été faite dans une perspective comparative. Bridging the Conceptualization of Youth with Intellectual Disabilities to Sentencing under the YCJA

The current study examined how disability and the concepts of risk, need and responsivity are understood by criminal justice professionals and inform their perceptions of young offenders with ID at sentencing under the ‘different but equal’ philosophy. Semi-structured interviews were conducted with 11 lawyers and 8 mental health workers across 6 major urban areas in Ontario. Participants primarily perceived ID through a medical discourse, overlooking social and structural barriers that, in some cases, may hinder adherence to sentencing dispositions. Specifically, participants discussed balancing the reduced culpability of offenders (e.g., intent) – justifying lenient sentencing – with public safety concerns (i.e., ID viewed as a barrier to rehabilitation) – justifying increasing the severity of sentences. Participants assessed clients with ID and their risks, needs and responsivity within the context of other legal factors: criminal history, severity of the offence, and YCJA objectives. This paper exploits a natural experiment approach to identify the impact of legislation (Employment of Children Act 1991) in Pakistan on participation of children in the labor markets. The law prohibits employment of children less than 14 years of age in sectors other than agriculture or household enterprises. With micro-data, making use of regression discontinuity data design, the study finds some evidence that the Employment of Children Act 1991 helped in reducing the employment of children immediately after its implementation.

The Canberra reintegrative shaming experiments indicate that offenders are more deterred from repeat offending after experiencing the restorative justice approach of diversionary conferencing than after court proceedings. Drink drivers predict more dire consequences especially with their families, if they are caught offending again after a conference than after court. Both young offenders and drink drivers are more likely than offenders sent to court to say they will obey the law in the future.

These preliminary findings of the evaluation by ANU researchers of the Canberra police conferencing program are especially important because some critics have called shaming conferences a "soft option". Interviews with the first 548 offenders in the study suggest that is not how the offenders see it, especially after experiencing over an hour under the spotlight of critical examination by family, friends, victims or community representatives sitting in a circle in a private room at a police station. There is a recurrent and intensifying problem of over-incarceration and recidivism among Indigenous youths in Australia. Although less than five per cent of young Australians are Indigenous, they account for almost half of the youths in detention. The Australian Institute of Health and Welfare found that between 2009 and 2013 the level of Indigenous over-representation among detained youths increased from 26 to 31 times the non-Indigenous rate. The latest Indigenous disadvantage report corroborates this trend, finding that the daily average detention rate for Aboriginal and Torres Strait Islander youth increased sharply between 2000-01 and 2007-08 and remained high in 2012-13 at 365 per 100 000 10-17 year olds, around 24 times the rate for non-Indigenous youth. Moreover, Indigenous youth re-offending rates remain consistently high. Between 2003-08, 53 per cent of young Indigenous people who had been arrested were repeat offenders.

As American judges move steadily towards greater humiliation and stigma as punishments for convicted offenders, the Australian Federal Police in Canberra are showing that shame does not require humiliation. In hundreds of drink driving and young offender cases over the past two years, the AFP have adopted alternative restorative justice techniques recommended by ANU Professor John Braithwaite. Professor Braithwaite has defined two different kinds of shame. One kind is stigmatic shaming, which disintegrates the moral bonds between the offender and the community. The other is reintegrative shaming, which strengthens the moral bonds between the offender and the community. Stigmatic shaming is what American judges employ when they make an offender post a sign on his property saying "a violent felon lives here", or a bumper sticker on his car saying "I am a drunk driver". Stigmatic shaming is designed to set the offender apart as an outcast for the rest of the offender's life. By labelling him or her as someone who cannot be trusted to obey the law, stigmatic shaming says the offender is expected to commit more crimes. Professor Braithwaite's alternative to stigmatic humiliation is to condemn the crime, not the criminal. It gives offenders the opportunity to re-join their community as law-abiding citizens. Between 1978 and 1992 the number of juvenile offenders aged under 17 in England and Wales who were removed from home under sentence and sent to institutions such as detention centres, borstals, youth custody institutions or residential Community Homes with Education fell from 14,000 to 1,800. This thesis documents how this significant decarceration came about, and why it has been given little attention in the criminological literature, placing it in context of developments in juvenile justice legislation and practice between 1965 and 1996 and theories of policy change. It suggests that the key development was the funding of charity and voluntary sector organisations to provide Intensive Intermediate Treatment programmes to juvenile courts as an alternative to custody, and the development of a small group of practitioners willing to act as campaigning advocates for young offenders in court. Interviews with key politicians, civil servants, academics and practitioners from this period are used to explore these trends in more detail, and consideration is given to the respective roles of the Home Office and the Department of Health and Social Security and the tensions between them over responsibility for young offenders. The Child Justice Act 75 of 2008 establishes a criminal justice system for child accused, separate from the criminal justice system which continues to apply for adult accused in South Africa. The Act aims to keep children out of detention and away from the formal criminal justice system, mainly through diversion. When these interventions would be inadequate or unsuccessful, the Act provides for child offenders to the tried and sentenced in child justice courts. Until now there has been little discussion of the details of the provisions dealing with sentencing. Sentencing in a child justice court is regulated by chapter 10 of the Act and section 68 is the first section in this chapter. This section effectively amounts to the "jurisdictional" provision of the new child sentencing system: it not only mandates child justice courts to impose their sentences in terms of the Act, but also provides the first set of boundaries (or the first part of the framework) within which sentencing should take place. Despite its brevity, section 68 is not without interpretative challenges. Of course, it has to be interpreted within the context of the entire Act. Explaining this context is the first function of this article. The various aspects of section 68 are further critically explored and discussed.

In the midst of concerns about serious offences committed by young people, the Child Justice Act is the first formal legislative step to introduce restorative justice in South Africa, and promotes reconciliation and problem solving as an approach to the criminal behaviour of youth. This article analyses the new place of restorative justice and ubuntu in the Act through an analysis of the Preamble, Objects and General Principles sections of the Act as well as the chapters on diversion and sentencing. It notes that there is a clear and consistent framework for restorative justice and ubuntu in the Act that accords with the Constitutional Court's understanding of both concepts. In addition, the article also enquires if the inclusion of these concepts has created a criminal justice system for children that does not hold them properly accountable for their actions. The question as to whether or not the Act has created a "just say sorry" regime is answered in the negative by way of reference to the numerous checks and balances included in the Act by the legislature.
