A avaliação de desempenho deve ser vista como um processo contínuo, objetivo e planejado que proporcione maior conhecimento da realidade da instituição. O trabalho tem como objetivo analisar os limites do atual modelo de avaliação de desempenho dos servidores administrativos adotado pelo Departamento de Polícia Federal, baseado na legislação vigente, nas normas que regem a matéria dentro do órgão e de informações coletadas através de pesquisa realizada com os servidores lotados no Estado de Pernambuco. Foi utilizado na pesquisa o método descritivo de natureza quantitativa através da aplicação de questionário à população escolhida. A partir da análise dos resultados obtidos foi possível identificar limitações referentes aos modelos utilizados, tais como: subjetividade, falta de comunicação entre os servidores e a chefia, ausência de feedback, utilização de critérios não diferenciados de acordo com o cargo, a não utilização dos resultados da avaliação como ferramenta para definição de ações de capacitação. A utilização dos resultados como um instrumento de negociação foi assinalado como possível pela maioria dos entrevistados. This can be noticed in spite of the variation at the voting given among different municipal districts and even among regions. Nessa dissertação, focalizamos uma região de pecuária do nordeste baiano nas duas últimas décadas do século XIX com o intuito de investigar as estratégias de ação e a cultura política dos vaqueiros em relação aos fazendeiros. Utilizamos fontes que tocavam mais de perto nessa relação: processos crimes sobre furto de animais, cartas enviadas por vaqueiros ao barão de Geremoabo e narrativas em verso e prosa a respeito da coragem dos vaqueiros para domar o gado bravio do patrão. Dessa forma, acessamos as formas sutis de dominação e resistência existentes nesse contexto. Ao contrário do que supunham autores como Euclides da Cunha, que visitou a região de Canudos durante a guerra de 1896, não havia uma ?servidão inconsciente? de vaqueiros em relação aos fazendeiros. Com o absenteísmo dos proprietários, os vaqueiros desenvolveram formas de impor respeito e serem socialmente reconhecidos conquistando um prestígio que os diferenciava dos trabalhadores ?comuns?. Reiterado em muitas ocasiões, este prestígio servia de contraponto à tentativa dos fazendeiros de manter um controle total sobre suas propriedades e sobre seus trabalhadores. OBJECTIVE: To evaluate a targeted HIV prevention programme among female commercial sex workers (CSWs) in the south of Thailand. SUBJECTS AND METHODS: A pretest-post-test comparison group study was carried out in Sungai Kolok and Betong between June and December 1994. In June 408 CSWs were entered in Sungai Kolok (the intervention area) and 343 CSWs were enrolled in Betong (the comparison area). In December 1994, 416 women were enrolled in Sungai Kolok and 342 in Betong. Of these women 37% (n = 283) also participated in the June survey. All women completed an oral interview and blood samples were collected for HIV serology. The intervention programme consisted of an informational and educational campaign and peer educator training. RESULTS: Increase in knowledge and perceived vulnerability was more pronounced in the intervention area but did not translate into a greater increase in condom use. Refusal of customers unwilling to use a condom and manager support in doing so were the only factors independently related to positive changes in condom use. HIV prevalence (approximately 20%) and incidence (approximately 4.2 per 100 women years) were the same in both study locations. Boundary work refers to the strategies deployed by professionals in the arenas of the public, the law and the workplace to define and defend jurisdictional authority. Little attention has been directed to the role of documents in negotiating professional claims. While boundary work over induced abortion has been extensively documented, few studies have examined jurisdictional disputes over the treatment of abortion complications, or post-abortion care (PAC). This study explores how medical providers deploy medical records in boundary work over the treatment of complications of spontaneous and induced abortion in Senegal, where induced abortion is prohibited under any circumstance. Findings are based on an institutional ethnography of Senegal’s national PAC program over a period of 13 months between 2010 and 2011. Data collection methods included in-depth interviews with 36 health care professionals, observation of PAC services at three hospitals, a review of abortion records at each hospital, and a case review of illegal abortions prosecuted by the state. Findings show that health providers produce a particular account of the type of abortion treated through a series of practices such as the patient interview and the clinical exam. Background: Commercial sex plays an increasingly important role in China’s growing HIV and sexually transmitted infection (STI) epidemics. In China, street-based sex workers (SSWs) are a subgroup of female sex workers with a particularly high risk of HIV/STI infections but are neglected in responses to HIV. This study assesses changes in HIV voluntary counseling and testing (VCT) utilization and high-risk sexual behaviors following a three-month HIV preventive intervention among SSWs in Chongqing, China. Methods: A three-month intervention was conducted by a team of peer educators, outreach workers from community-based organizations and health professionals. It mainly included distribution of free pamphlets and condoms and delivery of onsite and clinic-based VCT. Cross-sectional surveys were conducted prior to (n = 100) and immediately following (n = 112) the intervention to assess its impact. In-depth interviews were conducted among 12 SSWs after the intervention to further explore potential barriers to HIV prevention. Results: The intervention significantly increased SSWs’ participation in VCT (from 2.0%–15.2%, P < 0.001). Despite participants’ improved HIV-related knowledge level (from 24.0%–73.2%, P < 0.001), there were minimal changes in the levels of condom use with clients. Le présent mémoire s’intéresse aux interventions policières en contexte de crise. Il s’attarde plus particulièrement à l’usage de la force par les structures d’intervention spécialisée. L’intérêt de cette étude découle principalement du manque de connaissances empiriques sur le sujet. L’objectif général de cette étude est de comprendre les éléments qui peuvent expliquer le recours à la force par les structures d’intervention spécialisées et de vérifier si ces facteurs varient selon le type de menace auquel font face les policiers. Nous nous sommes intéressés à 438 événements de crise suicidaire, de barricade et de prise d’otage qui se sont déroulés au Québec, de 1990 à 2011, et durant lesquels est intervenu le groupe tactique d’intervention (GTI) de la Sûreté du Québec (SQ). Pour une meilleure compréhension de cette problématique, il sera en premier lieu question de comparer, selon leur niveau de risque, les personnes présentant une menace uniquement pour elles-mêmes avec celles présentant une menace pour autrui et les personnes qui présentent une menace tant pour elles-mêmes que pour autrui. peer-reviewed; In examining the contours of criminal law and its application, most lawyers and criminologists are drawn to traditional ‘real crime’ (homicides, violent assaults, organised crime, sexual offences, requirements of mens rea and actus reus, and general defences) whilst ignoring white collar offences which are often enforced by specialist agencies. As a society we have tended to be preoccupied with the ‘punitive regulation of the poor’, a project closely tied to a police-prisons way of knowing that focuses on ‘crime in the streets’ rather than ‘crime in the suites’ (see J Braithwaite (2003) and ‘What’s Wrong with the Sociology of Punishment’ 7(1) Theo. Crim. 5-28 at 7). The narrow exclusivity of this approach is a mistake, not least because criminalisation is now more than ever viewed as a panacea for almost any social problem. More and more Irish society is witnessing the increasing and extensive use of regulatory strategies by the Irish state. In areas such as competition law, environmental protection, health and safety law, and consumer and corporate affairs, there has been a move towards using criminalisation as the last-resort strategy when compliance through negotiation and monitoring has failed.

This paper contains a critical discussion of the opening of the highway concession to the private sector in Italy over the past 20 years. It describes the political context, legal mechanisms and regulatory settings; offers an analysis of the changes in the equity composition of concessionaires after the introduction of public-private partnerships, quality standards, and tariff dynamics; and provides some examples. The Italian experience reflects the typical problems of the "build-now-regulate-later" approach recognized in the highway public-private partnership literature. The Italian model is also characterized by the existence of an overly complex regulatory framework, as well as the lack of a single agent in charge of contract enforcement and independent data collection.

Appropriate public sector remuneration policies are key for performance. They can motivate staff to a limited extent by rewarding performance but more generally by eliminating inequities and avoiding frequent and sudden changes in pay. They can also assist in retaining competent staff one of the most critical drivers of public sector performance. Developing pay policy in the public sector is complex, administratively and politically. This note analyzes one approach to creating a fiscally sustainable, equitable and performance enhancing pay policy, the single pay spine. It focuses on the single pay spine as a means to help countries achieve four pay policy objectives: 1) ensuring that public service pay is affordable; 2) achieving competitiveness with pay outside the public service; 3) promoting greater transparency in public pay; and 4) ensuring that there is equal pay for equal work (i.e. eliminating inequity).

The Country Procurement Status Review (CPSR) report was prepared on the basis of the findings from a joint World Bank (WB)/Asian Development Bank (ADB) mission that visited the Kyrgyz Republic in February 2012. The main objectives of the CPSR are: (a) to analyze the Kyrgyz public procurement system, including the existing legal framework, organizational responsibilities, control and oversight mechanisms, capacity, and current procedures and practices, as well as how well these work in practice; and (b) based on these analyses and review, to identify key areas for improvement in public procurement and prepare an action plan for implementation of related revisions to the public procurement system. The report has three chapters: (I) Introduction; (II) Assessment of the Public Procurement System; and (III) Recommendations and Action Plan. A summary of the main findings and recommendations is provided in the Executive Summary at the beginning of the report. The detailed assessment of the Baseline Indicators is provided in Annex C. Additional Provisions for National Competitive Bidding under WB-financed operations is provided in Annex D.

This report analyzes the conflict resolution mechanisms among pastoralist societies in northern Kenya who have a long history of conflict but were by and large not involved in recent hostilities. It is based on qualitative research data that was collected during field visits between July and November 2007 in three arid lands districts in Northern Kenya - Isiolo, Baringo/East Pokot and Garissa. Research areas were selected to gain insight into conflict and legal dynamics among a variety of ethnic groups and in differing ecological and political environments. Research tools mainly consisted of semi-structured interviews, focus group discussions and participant observation. New research tools, such as legal aid days, were piloted during the study. About 80 interviews were conducted with a broad range of individuals, ranging from formal authorities to peace committee members, NGOs, CSOs, informal authorities, women groups, youth groups and others.

The conflicting relationship between peace and justice is frequently debated in the field of transitional justice. The obligation to prosecute serious crimes can contradict the measures necessary to reestablish peace among society. The predicament gives rise to a similar, though less obvious, challenge in many developing countries, where the formal justice system can be at odds with conflict management initiatives. Often, due to their inaccessibility or incompatibility with local socio-cultural norms, official justice institutions in developing countries do not fully penetrate the whole of society. In response, conflict management and peace building initiatives have proven to be more flexible and responsive to socio-political realities. While such initiatives may be more efficient in reestablishing the peace between communities in conflict, they may contradict the official law. Current policy efforts and practices in the arid lands of Kenya illustrate this dilemma. Reports in both the national and international media and anecdotal evidence indicate that the prevalence of crime and violence is high in PNG, and presents an important obstacle to long-term development. A growing body of literature and data on the issue identify a diverse range of forms of crime and violence; from violence in the household to violent conflict between clans, and various forms of interpersonal violence. This violence has been linked to various factors, ranging from historical and cultural factors, to, more recently, economic drivers. Conflict and violence have historically been an integral part of social life in PNG. This briefing note presents an analysis of the drivers of violence and crime in PNG. Fifteenth October 2011, a global day of anti-austerity action called for by the Spanish indignados, saw hundreds of thousands of protestors converging on Rome for a national march. One of the largest, this Rome event was however one of the most problematic, as it was disrupted by violent protests and the lack of will or capacity by the police to protect peaceful demonstrators. In this article, based on interviews with social movement organisers and police officers as well as documentary analysis, we examine similarities and differences between the 2001 G8 Genoa counter-summit and the demonstration of October 15th in Rome by analysing the specific characteristics in the police use of coercive techniques on the street, negotiation (or lack thereof) and the gathering of information. Approved for public release; distribution is unlimited; Governance processes in the public sector establish policies and institutionalize procedures for how organizations work together. Developing and sustaining these governance processes may be difficult. Efforts to develop a regional wireless interoperable communications network in the Phoenix metropolitan area resulted in a series of successes and failures. This thesis uses a classic case study framework to examine the governance development process from 1999 to 2015 among the City of Phoenix, City of Mesa and additional parties. Three distinct phases in the governance development process were identified and used to conduct a comparative analysis. Seven executives involved in the process were interviewed to provide insight and experience related to the governance development process across the three phases. The comparative case analysis illustrates factors that contributed to the success and failure of the network’s governance. Recommendations are provided that other agencies may employ in their own governance development to accelerate the process or avoid potential pitfalls and achieve successful outcomes more quickly. Within the past decade, two major events raised the national profile of the experiences of black youth and the realities of racism in the city of Kingston, Ontario. The first event occurred in the spring of 2001 and involved the dramatic “high-risk takedown” by Kingston Police of two innocent black male youths who were wrongly profiled as suspects in an assault case. The second event involved the subsequent release of a report commissioned by Kingston Police which confirmed that black male youth in Kingston were almost four times more likely to be stopped and questioned by Kingston police than any other racial group (Wortley and Marshall, 2005). This research, while not addressed to the specifics of racial profiling and policing in Kingston, focuses on the marginalized voices of male and female black youth in Kingston. Eight youth volunteered to participate in this study. Participants took part in one-on-one interviews with the researcher and three participated in a follow-up focus group session. Themes explored in the one-on-one interview and focus group sessions included factors influencing the construction of black identities within a predominantly white city, the negotiation of friendships and relationships, and interactions with public authorities such as teachers and the police. Teaching model of the Police Negotiation Process Based on Petri Nets is a study that aims to help the teaching process of strategic negotiation in critical situations involving hostages, allowing the improvement of the Military Police of the State of Alagoas in non-routine police reports. Two types of research were used in the methodology construction of this study: literature research through printed and electronic sources, as well as field research, questionnaires and interviews with military policemen working at the Center of Crisis Management, Human Rights and Community Police (CGCDHPC) in the State of Alagoas. Initially, it discussed the Learning Environment, focusing them as a support system to the learning process. Strategies of persuasion are formally defined in order to be applied in the police negotiation process. We understood the process of strategic negotiation in situations where hostages are involved.
