O trabalho discute o problema da concentração dos meios de comunicação social no Brasil. A preocupação inicial está voltada para a análise da realidade do setor de mídia brasileiro. Procura-se, por meio de estudo interdisciplinar, identificar os traços essenciais da formação econômica e política da sociedade brasileira, apresentar algumas notas sobre a evolução histórica do processo de concentração de poder no setor de comunicação social e traçar um retrato da concentração da mídia brasileira. Em seguida, pretende-se desenvolver uma reflexão crítica sobre a realidade brasileira. Partindo do enunciado de algumas hipóteses de caráter axiológico-normativo relativas à organização do setor de comunicação social, procura-se avaliar a robustez de tais premissas. Nesse contexto, avalia-se a importância de valores como a difusão do conhecimento para a promoção do desenvolvimento e o pluralismo de idéias e opiniões para o debate na esfera pública e a vitalidade da democracia. Também são estudados os princípios estabelecidos pela Constituição Federal relativos à organização do setor de comunicação social. The objective of this paper is to bring elements from the philosophical movement of hermeneutics and pragmatism to the discussion on methodology in economics, with a specific concern on the theory of truth. Our aim is to present the concept of the hermeneutic space, developed by the philosopher Richard Rorty, as a rational justification for pluralism in economics. We consider the hermeneutic space an interesting concept which should allow us to overcome the void left by the incapacity of epistemological theories to explain the evolution of sciences. It defends the idea that our culture, values and ways of interpreting things are what build the sciences, not any closed epistemological method. In this sense, pluralism is nothing more than letting the hermeneutic space work, without epistemological barriers, and understanding that this is desirable for the future development of economics as a science. This approach differs from all other methodological justifications for pluralism because it does not rely on any epistemological method, but assumes that the hermeneutic space can entirely fulfill the gap created by them

Mossurize is a Mozambican central-western district in the border with Zimbabwe. This border has always been porous since it was established in 1891. During the colonial period the population escaped through the border whenever they felt threatened. The same happened after independence, when the ruling party (FRELIMO) decided to remove the rule of traditional authorities. FRELIMO’s attempts to remove chiefs have proved to be useless, so it was decided to set chiefs as mediators between the government and the communities. Chiefs now have to “dispute” power at local level. In other parts of the country the boundary-marking in legal orders and domains of authority is set between the state (law/crime), chiefs (traditional cases) and the FRELIMO organizations (community rules and social cases). Is Mossurize any different? Does the border influence chiefs’ authority? This paper will look at these questions and relate them with the evolution of legal pluralism in Mozambique. The re/establishment of the ‘rule of law’ in transitional countries has become a mantra of the international community. At its core, the rule of law assumes that the state enjoys a monopoly of law. This thesis argues that the promotion of the rule of law in transitional countries gives insufficient attention to whether a strong level of legal pluralism exists, in that forms of non-state law, such as customary law, operate in parallel with state law and are preferred by a large proportion of the population. A strong level of legal pluralism is the norm in many regions of the world, particularly in Africa, Asia and the Pacific, where between 80 to 90 per cent of disputes are taken to non-state legal mechanisms for resolution. Many transitional countries face the problem of establishing the rule of law in a weak justice sector where a gulf separates local legal norms from national, constitutional norms that are drawn largely from the international sphere.As a case study of East Timor this article challenges simplistic positivist notions about the normative hierarchy of laws within a constitutionally bounded polity. It argues that in transitional countries such as East Timor legal pluralism is important but must be properly tuned to serve the rule of law. Legal pluralism poses certain dangers when it operateswithout any of the checks or balances that ensure accountability and the promotion of constitutional values such as equality. The rule of law is not served by an informal system where there are no formal avenues of appeal and thus minimal accountability and transparency. What is constitutional pluralism? What does it stand for? What does it want to achieve, contribute, or change in the European integration? Is it a viable, desirable or perhaps even an indispensable theoretical take on it? These were the leading questions discussed in the Symposium “Four Visions of Constitutional Pluralism” at the European University Institute in January of this year. Within the framework of the Legal Theory Working Group and under the auspices of the Academy of European Law, the organizers, Matej Avbelj and Jan Komarek, hosted four key scholars from the field of the EU legal and constitutional theory. Julio Baquero Cruz, Mattias Kumm, Miguel Poiares Maduro, and Neil Walker engaged in a groundbreaking three-hour discussion of their respective theoretical visions of the European integration. In the traditional legal culture, the expression of “ordering pluralism” is rather unusual. Pluralism implies differences, dispersion and fragmentation, whereas “legal order” leads us to think in terms of a unified structure. From this perspective, a legal order is necessarily unified, hierarchical and almost static. But our legal history has changed and we must rise to the challenge of changing our minds. The world is not static but interactive and rapidly evolving. In Europe, a supranational legal order was established after the end of World War II. In the whole world, the end of Cold War accelerated the so-called globalisation of law. In this new global world, we have to observe the different processes used for ordering pluralism by integrating the plural without reducing it to the identical. Using “ordering”, rather than “ordered” pluralism, because it is a way to stress the processes of integration rather than the results, the movement rather than the model. Looking at these processes, we will identify different degrees of integration, different levels in space, and different speeds in time to analyse the possible answers to a series of questions: How? This paper explores the notion of media pluralism and its application mainly from the European Union (EU) substantive and institutional law point of view so as to speculate on the possibility for a European approach to media pluralism and on the forms and routes it might take; especially once appreciated the limits and shortcomings of traditional approaches, against the background of the competence debate in respect of media pluralism and media freedom. Thus, the first section offers a theoretical (and slightly historical) background of the notion of media pluralism, in its various dimensions, at EU level. The second section, then, sketches an analysis of the notion of media pluralism, having regard to legal sources of primary and secondary EU law, as well as to the relevant European Court of Justice (ECJ) case law. Finally, a third (and open) section builds on the difficulties in traditional hard-law approaches to tackle media pluralism at EU level, and proposes some speculation on alternative modes of governance for the media at European stage: namely, the cooperation/coordination of National Regulatory Authorities (NRAs) at supranational level. This is reflected in the proposed case-study on the drafting of Article 30 of the Audiovisual Media Services Directive (AVMSD).; The Centre for Media Pluralism and Media Freedom is co-financed by the European University Institute and the European Union.

This report presents the phenomena of media freedom and pluralism and the major academic and policy debates about their social, political, economic role and implications. It highlights the importance of media freedom and pluralism for the functioning, sustainability and legitimacy of a democratic regime, and therefore the necessity for relevant policy actions. The text also provides a state of the art perspective on the measuring and evaluating of media pluralism. It analyses major aspects of media economics and ownership, including the tendency to media concentration, the potential relationship between pluralism and the increased number of sources of supply, the impact of emerging "Internet native" media players, and globalisation. The legal core of the report examines the development of the debate on legal instruments and jurisprudence, as well as those EU legal instruments that are currently available to tackle the areas of media pluralism and media freedom. Following on from the few EU instruments that are presently in place, and the general legal uncertainty present in this field, the report aims to suggest how the legislation in force could be used or modified in order to foster media freedom and pluralism in a more efficient way.

El presente artículo pone de manifiesto el carácter polisémico del pluralismo jurídico y el derecho alternativo, así como la interrelación que existe entre ambas perspectivas. A fin de despejar algunas confusiones y equívocos que subyacen en el contexto del pluralismo jurídico, se distinguen dos modelos análisis. Por un lado, el pluralismo jurídico en estricto sentido; y por el otro, el pluralismo jurídico de base monista, señalando que sólo en el primero de ellos, es susceptible una lectura en clave de paradigma en el contexto a la crítica de la ciencia jurídica tradicional; This article highlights the multiple meanings of legal pluralism and alternative law, as well as the relationship that exist between both perspectives. Este trabajo examina las diferencias entre el multiculturalismo y el interculturalismo a nivel prescriptivo y extrae sus consecuencias para pensar el pluralismo jurídico. Los dos enfoques aceptan la necesidad del pluralismo jurídico formal para hacer igualitarias las relaciones entre grupos culturales en el interior del Estado. Sin embargo, tienen consecuencias distintas desde una perspectiva prescriptiva. Los fundamentos normativos del multiculturalismo —la tolerancia y la coexistencia entre grupos culturales y la salvaguarda de los valores liberales— se traducen en un pluralismo jurídico desigual que establece grandes limitaciones en términos personales, territoriales y materiales para los sistemas jurídicos de grupos culturales no liberales. This paper examines internal pluralism in the governance of public service broadcasters in Spain, a dimension of pluralism on which very little research has been done in this country. In particular, it analyses the role played by social groups and professionals in the management structures of Spanish public service broadcasters through their participation in the advisory councils and professional councils of such media. This article describes and analyses the regulatory frameworks and the current pluralism protection policies in the United States and several countries of the European Union (Germany, France, the United Kingdom, the Netherlands, Italy and Spain). The data obtained allowed a qualitative assessment to be carried out, through a comparative analysis, in order to identify certain similarities and some significant differences. Thus, it was found that pluralism protection is a common denominator in the communication policies of these countries. A central question in the debate surrounding contemporary proposals for a new international order is whether accepting the fact of global pluralism should lead us to lower our ambitions for global justice. Many participants in that debate answer such a question positively. Even authors such as Rawls and Habermas both prominent defenders of ambitious conceptions of domestic justice seem to reach the same pessimistic conclusion with their respective proposals for a new international order. In this paper, I question the plausibility of such a conclusion on the basis of an analysis of the cosmopolitan project that Habermas articulates in recent publications. I argue that his presentation of the project oscillates between two models. The first is an ambitious model for a future international order geared towards fulfilling the human rights goals of the UN Charter. The second is a minimalist model, in which the international community’s obligation to protect human rights is limited to the negative duty of preventing wars of aggression and massive human rights violations stemming from armed conflicts such as ethnic cleansing or genocide. According to this model, any more ambitious goals should be left to a global domestic politics, which would have to come about through negotiated compromises among domesticated major powers at the transnational level. I defend the ambitious model by arguing that there is no plausible basis for drawing a normatively significant distinction between massive human rights violations stemming from armed conflicts and those stemming from regulations of the global economic order. El objetivo principal es examinar si hay una evolución en el cambio de políticas de medios de la UE desde la estricta regulación gubernamental a un enfoque de gobernanza suave con respecto a la protección del pluralismo desde el 2000 hasta el 2014. The protection of pluralism in a cross-media scenario is a major concern for regulatory authorities in all democratic countries. This paper presents the outcome of in-depth interviews with members of six independent audiovisual regulatory authorities. They were questioned about the assessment of measures being taken to protect external pluralism in their respective countries, and about the problems and shortcomings they encounter during their implementation. In spite of the difficulties that arise when trying to compare different national realities and to gather qualitative data from legal bodies, this paper draws several conclusions on current policy trends for the protection of pluralism.

An analytical framework is developed to ascertain when legal pluralism is problematic in the control of wrongdoing. It is demonstrated that there are three specific cases: rivalrous compliance, sanctions for wrong behaviour that are deemed to be wrongs themselves, and the uncoordinated sanctioning of common wrongs. Then there is a discussion of the consequences and some approaches that can be used to ameliorate each case that has been identified. It is hoped that this framework will be used to guide future practical and theoretical discussions on legal pluralism and its potential problems.

This article reflects upon the utility of legal pluralism theory for understanding a topic that is part of city everyday life: the legal regulation of urban public spaces. From a descriptive standpoint, legal pluralism theory reveals that patterns of exclusion can be constituted because urban public spaces consist in valuables permeated by intricate property arrangements that are established by an interlegality of state and non-state norms. From a prescriptive standpoint, the model of participatory and communitarian legal pluralism offers an adequate theoretical foundation for constructing property arrangements designed to assure the effectiveness of the right to the city.; Este artigo reflete a respeito da utilidade da teoria do pluralismo jurídico para a compreensão de um tema do cotidiano das cidades: a regulação jurídica dos espaços públicos urbanos. Do ponto de vista descritivo, a teoria do pluralismo jurídico revela que padrões de exclusão podem ser constituídos porque os espaços públicos consistem em bens permeados por intrincados arranjos de propriedade, os quais são estabelecidos por meio de uma interlegalidade de normas tanto estatais quanto não-estatais. Do ponto de vista prescritivo, o modelo do pluralismo jurídico comunitário-participativo oferece um referencial teórico adequado à construção de arranjos de propriedade nos espaços públicos que assegurem a efetivação do direito à cidade.
