Introdução: A presente tese, a partir de uma análise estratégica, articula as dimensões da teoria organizacional no campo da administração pública, o objeto de estudo-trabalho processo saúde-doença, a prática profissional integral e o planejamento estratégico situacional, por meio da Estratégia de Atenção Primária à Saúde. O propósito é o de, a partir da articulação das dimensões referidas, compreender e situar os Programas de Saúde do México a nível nacional e do Distrito Federal, a nível local, e estabelecer sob que pressuposto, de bem-estar ou qualidade, se encontram elaborados. Ultrapassado o debate em torno de seu caráter jurídico, impõem-se ao direito das gentes, na atualidade, perspectivas desafiadoras de seus contornos sistêmicos. Como ponto de partida teórico deste estudo, adotou-se a verificação da natureza dos conceitos utilizados pelas teorias fragmentárias do direito internacional que tendem a desestabilizar sua característica de unicidade. Política e direito conformam preceitos que não apenas interagem, mas muitas vezes se identificam. Propõe-se investigar, para tanto, em que medida o resgate de estruturas jurídico-políticas tradicionais como aquelas da teoria geral do estado poderia contribuir à institucionalização da ordem mundial. L’objectif principal de cette thèse est d’explorer et d’analyser la réception de l’œuvre d’Eugen Wüster afin d’expliquer comment ses travaux ont influencé le développement disciplinaire de la terminologie. Du point de vue historique, les travaux de Wüster, en particulier la Théorie générale de la terminologie, ont stimulé la recherche en terminologie. Malgré des opinions divergentes, on s’entend pour reconnaître que les travaux de Wüster constituent la pierre angulaire de la terminologie moderne. Notre recherche vise spécifiquement à explorer la réception de l’œuvre wüsterienne en étudiant les écrits relatifs à cette œuvre dans la littérature universitaire en anglais, en espagnol et en français entre 1979 et 2009, en Europe et en Amérique. Réalisée dans le cadre du débat sur la réception de l’œuvre de Wüster, cette étude se concentre exclusivement sur l’analyse des critiques et des commentaires de son œuvre. This dissertation develops a process improvement method for service operations based on the Theory of Constraints (TOC), a management philosophy that has been shown to be effective in manufacturing for decreasing WIP and improving throughput. While TOC has enjoyed much attention and success in the manufacturing arena, its application to services in general has been limited. The contribution to industry and knowledge is a method for improving global performance measures based on TOC principles. The method proposed in this dissertation will be tested using discrete event simulation based on the scenario of the service factory of airline turnaround operations. To evaluate the method, a simulation model of aircraft turn operations of a U.S. based carrier was made and validated using actual data from airline operations. The model was then adjusted to reflect an application of the Theory of Constraints for determining how to deploy the scarce resource of ramp workers. The results indicate that, given slight modifications to TOC terminology and the development of a method for constraint identification, the Theory of Constraints can be applied with success to services. Bottlenecks in services must be defined as those processes for which the process rates and amount of work remaining are such that completing the process will not be possible without an increase in the process rate. The bottleneck ratio is used to determine to what degree a process is a constraint. Simulation results also suggest that redefining performance measures to reflect a global business perspective of reducing costs related to specific flights versus the operational local optimum approach of turning all aircraft quickly results in significant savings to the company. Savings to the annual operating costs of the airline were simulated to equal 30% of possible current expenses for misconnecting passengers with a modest increase in utilization of the workers through a more efficient heuristic of deploying them to the highest priority tasks. The nature of the process of meaning-making in science has been one of the central problems in the philosophy of science of the 20th century. Yet, in spite of strenuous efforts by many able philosophers and historians of science over the past three decades or so, our understanding of this process continues to be unsatisfactory and fragmented at best. The need for an adequate account has been particularly exacerbated by the "infamous" and often misinterpreted problem of incommensurability (of meaning), and its alleged consequence, the incomparability of scientific theories--which presumably threatens the rationality, objectivity, and progress of science. In this project, I argue that a new and revised cluster theory can be articulated, which meets the objections typically raised against (i) traditional (contextual or cluster) theories of meaning (Carnap, Kuhn, Gasking, Putnam, Achinstein) and (ii) theories of reference (Scheffler, Putnam, Kitcher). Such a theory is not only based on more plausible assumptions and principles, but, in addition, it satisfies the main adequacy requirements formulated by proponents of a "cognitive-historical approach" (Shapere, Nersessian, Kuhn). This dissertation consists of three chapters exploring the nature of normativity in ethics and epistemology, with an emphasis on insights that can be gleaned by comparing and contrasting debates within those two fields. In chapter 1, I consider particularism, a relatively recent view which holds that, because reasons for action and belief are irreducibly context-dependent, the traditional quest for a general theory of what one ought to do or believe is doomed for failure. In making these claims, particularists assume a general framework according to which reasons are the ground floor normative units undergirding all other normative relations. However, I argue that the claims particularists make about the behavior of reasons undermines the very framework within which they make those claims, thus leaving them without a coherent notion of a reason for action or belief. Chapter 2 concerns a problem arising for certain theories that take the opposite extreme of particularism and posit a fully general theory of what one ought to believe or do. In the epistemic realm, one such theory is process reliabilism. The state of business in the U.S. automobile industry is such that competition is fierce, and consumers have a perplexing number of alternatives from which to choose. The final purchase decision by the consumer is where most industry experts focus their attention and efforts. Incentives and price wars are common as manufacturers fight for fractional market share and long-term survival at the expense of corporate profitability. However, the buying decision occurs at the end of the purchasing process, and takes place only after a consumer has formed a list of acceptable alternatives that fit his/her consideration criteria. This thesis explores the consideration phase of the purchasing process--(awareness -> familiarity -> overall opinion -> consideration)--with the goal of developing an in-depth understanding that can be used to formulate a strategic recommendation for General Motors regarding improving the consideration levels of several of its brands. The thesis begins with research into the attributes that form consumer consideration sets, as described by marketing and behavioral science scholars. Various phenomenological models of particle multiplicity distributions are discussed using a general form of the grand canonical partition function. These phenomenological models include a wide range of varied processes such as coherent emission or Poisson processes, chaotic emission resulting in a negative binomial distribution, combinations of coherent and chaotic processes called signal/noise distributions, and models based on field emission from Lorentzian line shapes leading to Lorentz/Catalan distributions. These specific cases can be written as special cases of a more general distribution. Using this grand canonical approach moments and cumulants, combinants, hierarchical structure, void scaling relations, KNO scaling features, clan variables and branching laws associated with stochastic or ancestral variables are discussed. It is shown that just looking at the mean and fluctuation of data is not enough to distinguish these distributions or the underlying mechanism. Progress in the new information-theoretic process physics is reported in which the link to the phenomenology of general relativity is made. In process physics the fundamental assumption is that reality is to be modelled as self-organising semantic (or internal or relational) information using a self-referentially limited neural network model. Previous progress in process physics included the demonstration that space and quantum physics are emergent and unified, with time a distinct non-geometric process, that quantum phenomena are caused by fractal topological defects embedded in and forming a growing three-dimensional fractal process-space, which is essentially a quantum foam. Other features of the emergent physics were: quantum field theory with emergent flavour and confined colour, limited causality and the Born quantum measurement metarule, inertia, time-dilation effects, gravity and the equivalence principle, a growing universe with a cosmological constant, black holes and event horizons, and the emergence of classicality. A statistical theory of the mean field is developed. It is based on the proposition that the mean field can be obtained as an energy average. Moreover, it is assumed that the matrix elements of the residual interaction, obtained after the average interaction is removed, are random with the average value of zero. With these two assumptions one obtains explicit expressions for the mean field and the fluctuation away from the average. The fluctuation is expanded in terms of more and more complex excitations. Using the randomness of the matrix elements one can then obtain formulas for the contribution to the error from each class of complex excitations and a general condition for the convergence of the expansion is derived. It is to be emphasized that no conditions on the nature of the system being studied are made. Making some simplifying assumptions a schematic model is developed. This model is applied to the problem of nuclear matter. The model yields a measure of the strength of the effective interaction. It turns out to be three orders of magnitude less than that calculated using a potential which gives a binding energy of about -7 MeV/nucleon demonstrating the strong damping of the interaction strength induced by the averaging process.; Comment: 25 pages...

Further, its asymptotic growth rate —i.e. the largest eigenvalue of the transition matrix— completely determines the winning population in an equilibrium competition. However, due to the intrinsically heterogeneous nature of quasispecies, out-of-equilibrium fluctuations in population size might change the expected fate of competition experiments. Using a simple model for a heterogeneous population we quantify the probability that, after a population bottleneck, the a priori weaker competitor wins in a competition with a population characterized by a larger asymptotic growth rate. We analyse the role played by different degrees of neutrality in the outcome of the process, and demonstrate that lower neutrality favours the weaker competitor in out-of-equilibrium situations. The basic research question was: To what extent does the media coverage of events and processes in society affect initiatives in political life? We hypothesized that the mediatization of politics would increasingly tend to make members of parliament (MPs) base their initiatives on the media instead of receiving propositions from i.e. their constituencies or organized interests, thereby boosting the role of the media in the public policy process. The alternative hypothesis was that the combined effect of commercial pressures, fragmentation, and tabloidization have meant a decline in the influence of the media in setting political agendas. Based on these alternative hypotheses, the study intended to establish the number of incidents of referencing the media as a starting-point for political initiatives in the parliament. The study covered 15 years of parliamentary bills from elected private members of the Swedish Parliament, the Riksdag. Bills were studied comparatively over time —sampling the 1991-1992, 1996-1997, 2001-2002 and 2006-2007— parliamentary sessions to obtain a time-series of the prevalence of media quoted as sources of issues or problems needing political attention on a national level. O presente trabalho tem por objetivo analisar criticamente a teoria da prevenção geral positiva da pena construída por Günther Jakobs. Nesse passo, após uma digressão sobre a crise das teorias tradicionais da pena, analisa-se descritivamente o funcionalismo sociológico desde sua inauguração com Durkheim até a moderna versão sistêmica de Niklas Luhmann. Com base no funcionalismo sistêmico, Jakobs elabora a teoria da prevenção geral positiva em um percurso teórico que é apresentado em três diferentes fases. A segunda parte do trabalho analisa criticamente as bases sociológicas e jurídicofilosóficas do pensamento de Jakobs a partir de um viés da sociologia do conflito e da teoria crítica do direito. Por fim, além das críticas enunciadas pela doutrina penal, a teoria da prevenção geral positiva é confrontada com a realidade do processo de criminalização, de modo a revelar seu viés legitimador da seletividade do sistema penal, suas relações com o papel da mídia no incremento do autoritarismo penal, além do significado material da pena como imposição de sofrimento ao ser humano. This study proposes to analyze the electronic process in light of the constitutional principle of access to justice. Outlines brief historical evolution as the electronic process, emphasizing its recent positivity in the national laws to then point out the aspects under which this deployment may create obstacles to access to jurisdiction. Similar to what has 11.419/06 Law, the Law of Electronic Process, discusses the role of the judiciary in relation to the creation of mechanisms to eliminate or at least minimize such barriers. It also proposes solutions to these obstacles, discussing a model system deployment, in order to harmonize the principles of reasonable duration of proceedings and access to justice, in apparent collision course.; Esse estudo propõe analisar o processo eletrônico à luz do princípio constitucional de acesso à justiça. We want to consider anew the question, which is recurrent along the history of philosophy, of the relationship between rationality and mathematics, by inquiring to which extent the structuration of rationality, which ensures the unity of its function under a variety of forms (and even according to an evolution of these forms), could be considered as homeomorphic with that of mathematical thought, taken in its movement and made concrete in its theories. This idea, which is as old as philosophy itself, although it has not been dominant, has still been present to some degree in the thought of modern science, in Descartes as well as in Kant, Poincaré or Einstein (and a few other scientists and philosophers). It has been often harshly questioned, notably in the contemporaneous period, due to the failure of the logistic programme, as well as to the variety of “empirical” knowledges, and, in a general way, to the character of knowledges that show them as transitory, evolutive and mind-built. However, the analysis of scientific thought through its inventive and creative processes leads to characterize this thought as a type of rational form whose configurations can be detailed rather precisely. This research project stems from a single puzzle: how can constitutional amendments be unconstitutional? Adopting a combination of theoretical and comparative enquiries, this thesis establishes the nature and scope of constitutional amendment powers by focusing on the question of substantive limitations on the amendment power, looking at both their prevalence in practice and the conceptual coherence of the very idea of limitations to amendment powers. The thesis is composed of three parts. The first part is comparative. It examines substantive explicit and implicit limitations on constitutional amendment powers through manifold descriptions of a similar constitutional phenomenon across countries, demonstrating a comprehensive pattern of a constitutional behaviour. This process is theory-driven, and the second part of the thesis constructs a general theory of unamendability, which explains the nature and scope of amendment powers. The third part explains how judicial review of amendments is to be conceived in light of the theory of unamendability, and further assesses the possible objections to the theory of unamendability.
