O presente trabalho refere-se à análise da aplicação da boa-fé na arbitragem internacional. Para a consecução do objetivo do estudo proposto, a boa-fé é analisada a partir de seus conceitos clássicos subjetivo e objetivo. É estudada conforme suas diversas formas de conceituação nos principais sistemas jurídicos ocidentais, com referência principal aos sistemas romano, germânico e de common law. Em seguida, é compreendida em nível internacional, através do estudo detido de suas manifestações nos contratos internacionais do comércio, nos princípios contratuais de aplicação internacional e nos princípios gerais de direito do comércio internacional. O papel dos árbitros na veiculação dos preceitos internacionais do princípio da boa-fé é cuidadosamente verificado, incluindo o estudo da atividade do árbitro na escolha da lei aplicável às demandas. In public good provision situations, individual members of a group have a choice of contributing or not contributing to the provision of a good from which all benefit, including those who chose not to do so. In such a context, theories of rational choice predict that individuals will try to “free ride” on the contribution of others – they will attempt to enjoy the good without contributing, leading thus to the under or no provision of the good. However, contrary to rational choice theory or classical game theoretical predictions, people tend to voluntarily contribute to the provision of public goods. In fact, there is by now an impressive accumulation of empirical findings from experimental and field studies corroborating this conclusion1. The results obtained in experimental studies may be summarised by the following stylised facts: (a) experimental subjects contribute considerable amounts of their endowments in oneshot game situations; (b) in repeated games the level of contribution is high in the first round but contributions seem to unravel over time; (c) the levels of contribution heavily depend on the context in which the interaction takes place (namely, on the (im)possibility of face-to-face communication among experimental subjects). Poor hygienic sanitary conditions in the processing of enteral diets constitutes in risks of microbial contamination, and may involve complications in patients with enteral nutrition, ranging from infections digestive up to systemic infections. For this reason is important its microbiological control, whereas individuals to whom they are intended, are more susceptible to infections. Thus, this study aimed to compare the hygienic conditions of enteral diets before and after the implementation of Good Manufacturing Practices in a public hospital in Brazil. The study was developed in the Enteral Diet Unit of the Goiânia Emergency Hospital in three stages. In stage 1 before the implantation of good practices, carried out between November and December of 2008, was diagnosed the preparation conditions of the enteral diets by systematic observation of the conduct adopted by food handlers. Was applied the check list proposed by Resolution RDC nº 63 of Agência Nacional de Vigilância Sanitária/Brazil and realized microbiological analyzes of 40 samples of each element investigated: filtered water, powdered diet, reconstituted enteral diet and food handler s hand and nasal cavity culture. Accountability mechanisms are touted as a path to “good governance.” But are accountability mechanisms a sure route to achieving the objectives of “good governance”? Limited case studies have offered inconsistent evidence (Blair, 2000; Charlick, 2001; Devas & Grant, 2003). But empirical evidence of the relationships among principles of good governance—high citizen participation, low levels of corruption, high-quality service delivery—and accountability mechanisms is lacking. We examine the effectiveness of accountability mechanisms in Liberia and find relationships between measures of county level fiscal accountability and measures of good governance do not always produce expected results, making fiscal accountability mechanisms no guarantee for achieving goals of good governance.

This preliminary stocktaking report on the demand for good governance is an effort of the Demand For Good Governance (DFGG) peer learning network to bring together and highlight the wealth of existing knowledge and practices currently available to support DFGG across the World Bank. This report puts forth a framework with key principles for organizing the complex universe of DFGG efforts across sectors and regions. The paper also identifies entry-points areas of development assistance and illustrates a few good practice examples supporting and strengthening DFFG for the World Bank as it builds its understanding of the areas where the institution can scale-up these activities. Seit Mitte der 1990er Jahre, im Zuge der weltweiten Diskussion um eine Ausrichtung bürokratischer Verfahren am Ideal des Public Service, lässt sich auch auf europäischer Ebene eine Tendenz verfolgen, die dem Bürger im Verwaltungsprozess eine gewichtigere Position einräumt. Die vorliegende Magisterarbeit untersucht in diesem Kontext die Rolle des Europäischen Bürgerbeauftragten (auch: Ombudsman, im folgenden EB) bei der Entwicklung von Good Administration-Normen auf EU-Ebene in den Jahren 1995 bis 2003. Die Institution des EB wurde mit dem Vertrag von Maastricht als Element der Unionsbürgerschaft institutionalisiert und während der ersten beiden Amtsperioden durch den Finnen Jacob Söderman verkörpert. Sie stellt eine außergerichtliche Beschwerdeinstanz für EU-Bürger dar, untersucht Streitfälle mit allen EU-Institutionen, die in direktem Kontakt zu den Bürgern stehen und vertritt so dessen Interessen im europäischen Verwaltungssystem. Mit weitreichenden Untersuchungskompetenzen ausgestattet, ist der EB in der Lage, wiederholt auftretenden Missständen nachzugehen und die Verwaltungsverfahren der EU in zentralen Punkten wie Transparenz, Gleichbehandlung und Rechtschaffenheit fortzuentwickeln. The Code of Good Administrative Behaviour has passed fairly unnoticed in academic research on the principle of good administration. However, it is an important source to understand the meaning of this principle and concept in European administrative law, since it encompasses some of its dimensions that tend to be overlooked by the case law of the European Courts and also by European law scholars. Furthermore, contrary to what recent developments let believe – namely, the fact that the Commission refuses to put forth a proposal for a European regulation that would make the provisions of the Code binding – the Code remains relevant to map possible legal developments regarding good administration. Risk measures beyond the variance have shown theoretical advantages when addressing some classical problems of Financial Economics, at least if asymmetries and/or heavy tails are involved. Nevertheless, in portfolio selection they have provoked several caveats such as the existence of good deals in most of the arbitrage free pricing models. In other words, models such as Black and Scholes or Heston allow investors to build sequences of strategies whose expected return tends to in nite and whose risk remains bounded or tends to minus in nite. This paper studies whether this drawback still holds if the investor is facing the presence of multiple priors, as well as the properties of optimal portfolios in a good deal free ambiguous framework. With respect to the rst objective, we show that there are four possible results. If the investor uncertainty is too high he/she has no incentives to buy risky assets. As the uncertainty (set of priors) decreases the interest in risky securities increases. If her/his uncertainty becomes too low then two types of good deal may arise. Consequently, there is a very important di¤erence between the ambiguous and the non ambiguous setting. Under ambiguity the investor uncertainty may increase in such a manner that the model becomes good deal free and presents a market price of risk as close as possible to that re ected by the investor empirical evidence. This article examines the intrinsic relationship between Nietzsche’s conceptualisation of ‘beyond good and evil’ and his distinct view of the self. First, it focuses on Nietzsche’s genealogical analysis of morality, and by scrutinising this historical account of moral valuations the article then endeavours to present Nietzsche’s concrete philosophical standpoint on the fundamental necessity of value judgments which are constantly realised by individuals in their interactions with each other and with life. In this regard, it discusses the strong need to differentiate Nietzsche’s dismissal of the Judaeo-Christian scheme of morals, as good and evil, from his firm advocacy for creatively and only personally actualised valuations of good and bad. After delineating this essential distinction, the article portrays how Nietzsche’s view of the becoming self is interconnected with his proposal of the formation of moral valuations beyond good and evil. Finally, it conclusively elucidates how Nietzsche considers the self’s endless revaluation of morals beyond good and evil for the affirmation of life as its primary means to attain the unity of its selfhood, and it further illuminates his comprehension of this process as the prerequisite step for the self to realise the unity of its selfhood in its endless becoming.

Im Rahmen dieser Arbeit soll der konzeptionelle Zusammenhang zwischen Populismus und governance entwickelt werden, welcher zwar in der Literatur bisher impliziert, aber in dieser Form bisher nicht herausgearbeitet wurde. Im Vordergrund steht die Frage: Ist im Populismus good governance möglich? Daraus ergibt sich die Überlegung, welche populistischen Strukturen in welcher Weise auf die governance-Qualität wirken können. Da der Populismus des venezolanischen Präsidenten Hugo Chávez den ersten und schillerndsten der neuen lateinamerikanischen Populismus-Welle darstellt, wurde seine Regierungsführung als Gegenstand der empirischen Untersuchung gewählt. Darüber hinaus kann diese Untersuchung Beobachtungen zur governance-Qualität des Landes bieten, die trotz der großen Zahl der Veröffentlichungen zu Venezuela bisher fehlen. The Fair Work Act 2009 has brought about significant changes to industrial relations in Australia. It has significantly departed from the previous Liberal government's WorkChoices 2005 legislation in a number of notable ways. For the purposes of this paper, its new focus on collective agreements as the main means of setting wage and conditions for workers is of particular interest. Instead of individual agreements, where employees were expected to provide their own bargaining power, collective bargaining under the new legislation tries to provide employees with the resources of collectivisation and in particular facilitation of the bargaining process. The intention of the Act in this respect is to help the communication and interaction between bargaining parties through the idea of Good Faith bargaining (GFB). GFB within the Act provides firstly procedural requirements for bargaining parties, including organising and attending meetings, exchange of information and responding to proposals. This paper develops a simple model to analyze the interaction between strategic corporate public good provision, international firm location and national regulation. An information-based strategic corporate public good provision mechanism is proposed to shed light on recent firm behavior within different regulatory environments. The main insight derived is that in the presence of firms with geographic flexibility (multinational enterprises) and market provision of an international public credence good, unilateral (non-cooperative) regulatory scope depends on (1) the absolute probabilities to verify firms' corporate public good provision levels within different geographic and institutional environments, and (2) the differential between these probabilities across countries. The relative information asymmetry determines not only the market levels of the public good produced under autarky, but also the relocation incentives of multinational enterprises. This thesis explores some theoretical and empirical issues in the voluntary contributions to public good. Chapter I contains a brief motivation and introduction. In chapters II and III, we analyze two non-cooperative methods for either enhancing or mitigating externality-causing activities. Chapter II deals with positive externality in the public good contribution context, and chapter III with negative externality in the pollution abatement context. Chapter IV contains an empirical analysis of charitable donations by the elderly. Chapter II models the so-called ``corporate challenge gift'' used in real world fund-raising, and adopts the concept to voluntary contributions to public goods more generally. We model the process as a sequential game in public good contributions. One of the agents sets a quantity-contingent matching scheme to leverage higher contributions from the other players. Under the assumption that the preferences of agents are public information and the assumption that the scheme setter can commit to the matching plan, we show that the scheme brings efficient levels of total contributions to the public good. China has long been sceptical on mitigating sentences based on the offender’s good character, while good character mitigation is widely accepted in Canada. This study was to examine the justification of good character mitigation in Canada so that China can better face the future choice in sentencing: whether to consider good character a mitigating factor. Through examining the use of good character in Canadian sentencing practice, the justification of good character mitigation in Canada has been questioned. A three-part argument has been put forward to support the removal of good character as a mitigating factor in Canada: first, the workability of the very concept of “good character” is low; second, theoretical basis for mitigating sentences on good character is problematic; third, the present practice contributes to a form of status-based discrimination. This study shows that the justification of good character mitigation is not as strong as we have expected it to be. Good governance in the hands of the judiciary: lessons from the european example

This note is based on the author's guest presentation delivered at the Konrad-Adenauer Foundation/North-West University (Faculty of Law) Colloquium on 21 August 2009. Justice von Danwitz was invited to set the scene for further academic discourse on the broad topic of Good Governance and Sustainable Development. This contribution hence draws on the author's personal views and experience in the European context, and it is shown that the quest for good governance is universal and not specific to our times and that in fact, "(t)he true administration of justice is the firmest pillar of good government". The contribution considers what Europe has been able to realize in this field over the past 10 years by means of a description of the legal concepts and practical consequences of the quest for good governance in the European Union and some comments on the role of the judiciary in this process. The contribution serves to show that good government is a notion of which the meaning transcends geographical and jurisdictional borders and that it is possible for different countries and regions to exchange lessons and learning experiences in relation to good government in operation as well as the role of good government towards the achievement of sustainable development.

Recent international developments have emphasised the importance of good governance in land administration. Good governance practices are inter alia predictable, open and enlightened policy-making; accountable and transparent processes; a professional ethos that combats corruption, bias, nepotism and personal gain; and strict financial control and management of funding. This paper explores aspects of land administration where public funding and interests necessitate the application of good governance practices. The South African land reform programme is divided in three sub-programmes, namely land restitution, land redistribution and tenure reform. Land reform is a vast subject, based on policy, legislation and case law. Therefore it is impossible to deal with good governance principles over the wide spectrum of land reform. Special attention is however given to the land restitution programme in terms of the Restitution of Land Rights Act 22 of 1994and tenure reform in the rural areas by means of the Communal Land Rights Act 11 of 2004. The purpose is not to formulate a blueprint for good governance or to indicate which good governance principles will solve all or most of the land tenure problems. It is rather an effort to indicate that policies and procedures to improve good governance in some aspects of land reform are urgently needed and should be explored further.
