A presente dissertação aborda os diferentes aspectos que impulsionam a demanda pelo reconhecimento do direito humano à comunicação como um direito fundamental, assim como as características teóricas que compõe o escopo deste novo direito. A partir do relato histórico sobre a evolução dos meios de comunicação, aponta o papel da comunicação mediada por tecnologias no desenvolvimento e reprodução do capitalismo, e descreve as peculiaridades atuais do modelo brasileiro, constatando a insuficiência do direito à liberdade de expressão e do direito à informação para a garantia da dignidade humana no campo da comunicação na medida em que os mesmos não impediram a privatização da esfera pública. Este trabalho se fundamenta em uma concepção discursiva da democracia segundo a qual a comunicação pública é um elemento necessário à legitimidade da autoridade política. Segundo esse entendimento, a livre expressão de ideias é parte integral e condição essencial ao exercício das liberdades políticas em termos iguais. Tendo em vista a centralidade dos meios de comunicação na definição dos valores coletivos e na agência política, sustento que a sua estrutura deve ser orientada pelo reconhecimento de todos como pessoas livres e iguais. This study addresses, from a theoretically oriented perspective, the relationship between freedom of expression and democracy, trying to assess its implications for the regulation of mass media. Starting with a legal case in which a TV channel and a journalist were prosecuted for hate speech, looking at the reaction of the São Paulo Press Association to the case, I examine three perspectives on the statute and the reach of expressive liberties—the Millian Principle, the collectivist approach, and the participatory view—which connect these liberties to the ideas of moral autonomy and self-determination. For different, but related, reasons, these views present a conception of free speech that would not garner universal agreement in a pluralistic society. Moreover, some of the ideas defended could justify rules (or the absence of them) that might harm the social bases of self-respect. In opposition to these lines of thought, I argue for the fair value of communicative liberties; i.e., the idea that everyone should have access to the same rights and effective conditions to exercise communication. This means a fair distribution of opportunities for occupying the mediated public space and the establishment of rules to discourage the dissemination of ideas that fail to acknowledge the equal respect that we owe to each other as members of the political association. The main objective of this research was studying the meanings of the freedom of expression and what professors of Journalism think about the way those meanings are used in pedagogical practices. The term freedom of expression is commonly used in journalism even though it is not so studied, consequently we don t have a word to define it. This chapter in a forthcoming book attempts to map global patterns by which local tyrannies become sources of potentially global infringements on freedom of expression, particularly but not exclusively on the YouTube Web site. It illustrates certain parallels between the efforts to force copyright filters on YouTube and the Web in the West, and to harden the Great Firewalls of China, Arabia, and Persia in the East. The parallels include preemptive filtering, deep packet inspection, overbroad restrictions, and harms to user privacy. Generally speaking, blasphemy and seditious libel are the dominant forms of censorship in the impoverished and/or dictatorial societies of Africa and central and southern Asia, with insulting the great leader similarly controversial at the fringes of Asia including China, Thailand, and Turkey, and in the South Atlantic including Colombia, Honduras, and Zimbabwe. By contrast, intellectual property is prompting many of the Web site takedowns for political and cultural speech in the North Atlantic including Europe and the United States. The article inquires into a delicate and often prudish legal problem of erotic art in the paradigmatic dynamics of national law on obscenity and an ever-growing body of international law of cultural heritage. Pornography is a popular legal construction in distinguishing ‘high art’ from cultural practices, allegedly deprived of artistic value. Yet since when do we know what is the obscene or the pornographic and why do we outlaw certain narratives and visualizations from the realm of freedom of expression? This question remains ultimately vague in national law (predominantly embraced under the heading of boni mores, or ‘public morality’) and even more scattered in contemporary international law. The latter seems to silence somewhat uncomfortable and outdated developments on pornography of the early 20th century. Consequently, this piece is an attempt to trace the genesis and evolution of the legal interpretation of art in the dichotomy of freedom of expression and pornography.

This doctoral thesis inquires into the role and perspectives of the ‘European’ (mandatory) and ‘USA’ (persuasive) constitutional models of the right to freedom of expression for the constitutional debate in Central and Eastern Europe (CEE). This survey is based on the study of socio-legal developments in the Czech Republic, Hungary, and Poland, embracing the period of post-communist transition until 2010. The research focuses on three controversial issues in the realm of freedom of speech, namely (1) hate speech, (2) historical revisionism, and (3) pornography, before the U.S. Supreme Court and European Court of Human Rights. The essential novelty of the project is an assessment of European standards of free speech and non-discrimination beyond the mechanisms of the Council of Europe, encompassing the relevant aspects of EU law (judgements of the European Court of Justice and harmonised instruments) as mandatory standards for courts and legislators, including those in CEE. There is more to the denial of freedom of expression than outright censorship. The right to freedom of expression is interdependent with, and indivisible from, other rights guaranteed under the Universal Declaration of Human Rights. To discuss freedom of expression narrowly as if it were self-contained, and to conceal the issues, processes, and conflicts implicit in its achievement, can be seen as a hegemonic strategy that serves relations of domination. Three sets of public exchanges analyzed here, conducted on and about Arab television against a background of growing international intolerance for free speech, arguably contributed to a narrow, reified understanding of freedom of expression. The first centered on a television drama serial, the second on cartoons of the Prophet Mohammed, and the third on the ambitions of a privately owned television station in Egypt. Since freedom of expression was repeatedly referred to in all three cases, it might be said that Arab television increased awareness on this topic. Evidence shows, however, that instead of illuminating ways in which the rights and duties inherent in freedom of expression could benefit the viewing public, each set of exchanges helped to sustain power relations by obscuring them.; (Product of workshop no. 13 at the MRM 2008)

The increasing role of electronic media in news and, more generally, in content production is changing the scope and boundaries of the journalism profession and the instruments deployed to regulate the activity. Historically, journalism has primarily been self-regulated. The limits of public legislation, mainly driven by the constitutional constraints posed by the freedom of expression, have created different models of national private regulatory regimes across Europe. Media regulation is a multilevel architecture and national legal systems still play a primary role in designing rules concerning news production. Self-regulation reflects national approaches and varies according to legal and social regulatory cultures. Within the private sphere, different forms of regulation have been implemented reflecting the changing balance between the profession, the industries and the new players which have emerged after the Web revolution. The development of new media poses the following important challenges to that regulatory framework: the criteria to be used to define journalism; the distinction and the boundaries between professional and non-professional journalism; the distinction between commercial and social/not for profit content production. In the wake of the British phone hacking scandal of the News of the World, which proved some limits to the model of media self-regulation, a growing number of experts have suggested a statutory recognition of this model by law to improve its performance. At first sight a statutory recognition seems an oxymoron, as the model of media self-regulation – a voluntary system of media regulation independent from public authorities - was originally developed by media professionals themselves to limit state interference in the field of media. Hence, the article explores how statutory recognition is compatible with the concept of media self-regulation. After clarifying the relationships between media regulation, self-regulation and media freedom, the article investigates whether statutory recognition is beneficial or detrimental for media freedom. To answer it, this article draws a distinction between democratic countries and countries in democratic transition. It is argued that statutory media selfregulation in non-democratic countries is problematic because of the risks of transforming selfregulation into a compulsory system controlled by political interests. This report puts the EC proposal for a right to be forgotten in context and discusses it from the perspective of freedom of expression. As will become apparent, the right to be forgotten as proposed in data protection law is a concept that relates closely to the regulation of privacy harms caused by new forms of publicity online, most notably search engine and social media publicity. These new forms of publicity are the subject of daily news reports about the privacy impact of the Internet and related services Even though scientific literature shows that the Web is extremely volatile, that valuable information constantly disappears and that the structural preservation of historic publications online is a very hard problem, the perception that the Web never forgets seems to remain prevalent. Acting on concerns over online publicity, over the last decade, Data Protection Authorities (in France, Spain and Italy in particular) have laid the foundation for the establishment of strengthening the control of people over the public data that is processed about them online through a so-called ‘right to be forgotten’. Por esta razón, el Consejo de Europa decidió establecer un sistema capaz de defenderse frente a posibles amenazas antidemocráticas. This paper rationalizes in the transatlantic perspective the instrumentalisation strategies of the right to free speech in postmodern legal discourses, stemming from the recent twenty years of American critical studies (rethinking Marxism, liberalism, nationalism, and post-structuralism). Race, gender, and sexual orientation are, consequently, the deconstructionist markers of the three legal movements discussed, namely: (1) critical race theory, (2) feminist jurisprudence, and (3) LGBT legal discourse. The respective scholars ruin a comfortable myth of the law-neutrality and deconstruct the oppressive nature of legal settings. They challenge the value of pure l'expression pour l'expression and balance freedom of expression against the yardsticks of non-discrimination, providing an account of the victim-stories, usually disregarded and silenced in the traditional juridical discourses.

Différents points de vue pour déterminer la portée du secret des délibérations dans certains tribunaux internationaux ont débouché sur le fait que les juges aient le droit de présenter des opinions séparées; alors que d’autres n’ont pas ce droit. En tenant compte du rôle et des objectifs des missions internationales, les juges devraient avoir le droit de présenter des opinions séparées, de la même façon que dans le système de common law et dans un grand nombre de tribunaux constitutionnels.Cependant, ces analogies ont joué un rôle marginal dans les travaux préparatoires du Statut de la Cour Permanente de Justice Internationale en 1920. Although, Directive 95/46 include a special purposes provision for processing ?carried out solely for journalistic purposes or the purposes of artistic or literary expression?, its limited scope fails to provide for a general reconciliation of values in this area. As vividly highlighted by the recent Google Spain decision, these problems were only partially resolved in the Satamedia judgment. Proposed amendments to require Member States to effect a reconciliation between data protection and freedom of expression itself run the theoretical risk of expanding the scope of this highly discretionary clause into one of universal application. However, as this would clearly conflict with the core harmonizing aim of reform, it would almost certainly be interpreted much more restrictively, thereby fuelling existing confusions. Da mesma forma, investiga a luta pela liberdade de expressãoe a importância de discuti-la na atualidade.; Using discussions which took place in events carried out in the year of 2008 – to remember 40th anniversary of the AI-5 enactment, in Brazil, and 60th anniversary of the Universal Declarationof Human Rights – this text analyses the several meanings of the principles of citizenship, freedom and democracy, considering the historical confl icts and the political aspirations of different eras.Likewise, it analyses the struggle for the freedom of expression and the importance of discussing it in current days.

The main purpose of this paper is to examine the challenges the Federal Supreme Court of Brazil faces regarding the tax immunity of e-books, focusing on the fundamental rights to an ecologically balanced environment, to culture and to freedom of expression. Methodology used is bibliographical, theoretical, descriptive, dialetic and case law-based, being also mainly inductive. The issue of the tax immunity of e-books must be examined taking into account that postpositivism and neoconstitutionalism are basic references in modern Law. Different to the limited and misguided interpretation used by the Federal Supreme Court of Brazil, and based upon systematic and teleological interpretation methods, the juridical notion of book should be the widest possible, rendering legitimate and necessary a constitutional mutation, which would affect Section 150, IV, “d”, of Brazilian Federal Constitution. The author concludes that extending tax immunity to e-books contributes to the protection of a healthier environment, as well as to the diffusion of culture and to the promotion of freedom of expression.
