A presente tese tem por objetivo demonstrar que a sistemática para a satisfação da tutela jurisdicional dos interesses individuais homogêneos, prevista nos arts. 95 a 100 do Código de Defesa do Consumidor, é insuficiente, o que justifica a sua reforma legislativa para torná-la mais efetiva em nosso ordenamento jurídico, especialmente diante do atual cenário do Poder Judiciário brasileiro. Com esse propósito, a princípio, aborda-se a necessidade de adequação de tal disciplina à realidade social, a fim de que esse processo consiga satisfazer os direitos violados em um prazo razoável, o que passa invariavelmente pela correlata melhoria dos serviços judiciários prestados no Brasil. O objetivo central desta tese é verificar se e como a utilização da conciliação pode conferir efetividade à prestação jurisdicional, compreendida pela pacificação com Justiça, destacando a dimensão qualitativa do instituto. Contextualizou-se para tanto o tema, analisando o Poder Judiciário, a atividade jurisdicional e a cultura da pacificação na contemporaneidade, e se examinou em seguida o tratamento de conflitos por meios consensuais. A presente dissertação possui por objeto discutir o controle judicial da atividade normativa das agências reguladoras no direito brasileiro. O trabalho é dividido em três partes. Na primeira, é analisa a evolução do princípio da separação de poderes ao longo dos séculos XIX e XX, bem como a receptividade dele no início do século XXI, notadamente em virtude do processo de retirada do Estado da intervenção direta na economia, como prestador de serviços aos cidadãos, e sua recolocação como regulador das atividades econômicas. Os Juizados Especiais Federais Cíveis (JEFs Cíveis) despontam como uma das mais recentes instituições do Judiciário criadas para ampliar o acesso à Justiça no Brasil. Eles são responsáveis por solucionar conflitos entre cidadãos e agências estatais, constituindose num espaço de possível resistência contra as ilicitudes e descaso das agências do Estado responsáveis pela administração dos direitos sociais. A gratuidade de seus serviços, seus procedimentos simples e informais e as promessas de uma Justiça célere possibilitaram que muitos cidadãos desassistidos recorressem às suas instâncias, ampliando-se, assim, o acesso à Justiça. Porém, ao mesmo tempo em que a grande procura aos JEFs Cíveis possibilitou mostrar a realização da ampliação do acesso, ela também explicitou as fragilidades e as deficiências do modelo de resolução de conflitos adotado, através do qual a efetividade dos direitos pleiteados passou a se dar de modo precário e dependente de inúmeras circunstâncias. The research addresses the existence of a fundamental right of access to assisted human reproductive techniques in Brazil. It starts with the analysis of several international rules on reproductive rights, as well as principles of bioethics, in order to enter the Brazilian internal rules concerning the right to health, family planning and human dignity. Therefore, in the face of so many problems hindering the effectiveness of social rights, it is imperative that the Brazilian jurists ponder the right to having a legitimate child and regulating one s offspring, according to the reality of public finances in a country such as Brazil. Thus, the contempt for the exercise of a right which has legal and constitutional grounds is unacceptable, as highlighted several times in this research. Moreover, it provides great importance to administrative rules issued by the Brazilian State seeking the provision of assisted human reproductive services by SUS. In that respect, it also investigates how these services are being provided to the population of the State of Alagoas. This dissertation discusses the feasibility and potential of judicial control over public budgetary choices as a strategy to perform public policies that actualize positive social rights. After setting the theoretical foundations of what seems to be a "constitutionally adequate theory of the constitution" to a country whose Constitution settles state´s purposes and objectives and also establish fundamental social rights with a prominent installment function, which limits the action space of the Executive and Legislative Powers, especially regarding the definition and implementation of budgetary choices to accomplish these rights, the dissertation characterizes positive social rights as those which aim the creation of normative and material conditions that enable to overcome the historical inequalities that mark Brazilian society and that, along with other effectiveness contents, have as a main object the creation of public policies capable of passing the offering of public services and developing goods that can be enjoyed by the community and, especially, the most vulnerable groups in both social and economic perspective. The Turkish Ministry of Justice has identified the existing system of expert witnesses as an obstacle to the efficiency and effectiveness of the judicial services. The 2009 judicial reform strategy and the judicial reform action plan call for a comparative study analyzing the experience in other countries to provide input into the policy debate in Turkey. This study provides descriptions and analyses of approaches to the use of expert opinions in civil, criminal, and administrative court proceedings in France, Germany, Italy, and the United States. It focuses on five key areas: access to the function of expert, execution of an expert opinion, the opinion and its use in evidence, remuneration, and liability.

A Review of Credit Guarantee Schemes in the Middle East and North Africa Region

Many countries in the MENA region have established partial credit guarantee schemes to facilitate SME access to finance. These schemes can play an important role, especially in a period where MENA governments are making efforts to improve the effectiveness of credit registries and bureaus and strengthen creditor rights. This paper reviews the design of partial credit guarantee schemes in MENA, and assesses their preliminary outcomes. The paper is based on a survey conducted in 10 MENA countries in early 2010. The authors find that the average size of guarantee schemes in MENA (measured by the total value of outstanding guarantees) is in line with the international average, although there are wide differences across countries, and some schemes seem too small to make any significant impact. Most importantly, the number of guarantees looks generally small while their average value looks large. This suggests that guarantee schemes are not yet reaching the smaller firms. This paper explores the structure of cross-border health purchasing between Austria and Hungary and determines the size of this phenomenon as well as the barriers to a further increase. Austrian patients may receive health care treatment in Hungary in three different ways. First, patients may receive benefits in the context of the European Community Regulations 1408/71 and 574/72 (Category I patients). Second, outside those regulatory structures, Austrian patients travel to Hungary to receive medical treatment, especially dental treatment, and then seek reimbursement from their Austrian insurance (Category II patients). Third, some patients receive medical treatment in Hungary outside both schemes (Category III patients). There are about 42,500 Category I patients per year; and 58,000 Category II patients world-wide per year. This assessment of the anti-money laundering (AML) and combating the financing of terrorism (CFT) regime of the Arab Republic of Egypt (Egypt) is based on the Forty Recommendations 2003 and the Nine Special Recommendations on Terrorist Financing 2001 of the Financial Action Task Force (FATF), andwas prepared using the AML/CFT assessment Methodology 2004, as updated in February 2008. Governments use a variety of instruments to provide direct support to private enterprises. These include the provision of finance (subsidized and/or directed credit) and business development services (management and marketing advice to small businesses, agricultural extension services, support for enterprise level training and support to technology development). These interventions are distinct from those that support enterprises indirectly by establishing a policy and legal environment conducive to enterprise development. How effective have these direct support schemes been? This paper attempts to provide some answers to this question by surveying the available literature on the effectiveness of direct support interventions. Where available, impact evaluations suggest that the performance has been mixed at best. The International Monetary Fund (IMF) and the World Bank introduced the Poverty Reduction Strategy Paper (PRSP) process in 1999 to strengthen the poverty alleviation focus of their assistance to low-income countries. This report reviews Nicaragua s experience with the PRSP process, focusing on the effectiveness of IMF and World Bank support to the process and the extent to which the two institutions lending and non-lending activities in the country are aligned to the objectives of the PRSP approach. The report is structured as follows: section B provides background on poverty, the political and economic context, and history of national strategies in Nicaragua. Section C analyzes the PRSP process focusing on application of underlying principles, including through formulation and implementation processes. To advance the effectiveness of Uganda's public investment program (PIP) improvements can and should be made from the inception of an investment program all the way through its implementation. It is not a question of abandoning the current process but one of adjusting the various stages of the current PIP processes in place such that in particular quality at entry and readiness of investment projects improves, contract management gets strengthened, and above all incentives for implementation are enhanced. The aim of the adjustments to the PIP processes in Uganda is to ensure that the PIP can assist the government to direct resources to those investments that provide the highest economic and social return. The government is advised to revisit the current informational content of the PIP as well as the decision making process of the PIP at each of the phases of the PIP, i.e., preparation, evaluation, and implementation. This report develops an assessment framework and decision-making tool that, it is hoped, will facilitate evaluations of the effectiveness of telecommunications regulators in sub-Saharan Africa by the regulators themselves, World Bank staff, other institutions and their consultants. The assessment framework has been developed as part of a larger study in which the framework was developed and then applied in three sub-Saharan African countries, Mauritania, Uganda and South Africa. The individual country assessments are attached to this report as appendices. Good public procurement practices are a major determinant of the effectiveness of public expenditure. This paper examines the current status of justice and dispute-resolution mechanisms in Bangladesh, ranging from the formal justice system to the traditional shalish (a form of dispute resolution), and focuses on the costs and benefits of utilizing nongovernmental organization (NGO)-led legal services programs as an alternative form of justice delivery and dispute resolution for the poor, with a focus on women and girls. In particular, this paper takes a closer look at a the Human Rights and Legal Aid Services (HRLS) program of BRAC, a leading NGO that works to empower the poorest and most vulnerable in Bangladesh and eleven other countries across the world. HRLS provides a combination of Bangladesh Rural Advancement Committee (BRAC)-led shalish, human rights community based education, community mobilization through a corps of community-based outreach workers (known as shebikas), and recourse to the courts via a network of panel lawyers if needed. The World Bank published a Public Expenditure and Institutional Review (PEIR) of the Bulgarian justice sector entitled “Resourcing the Judiciary for Performance and Accountability: A Judicial Public Expenditure and Institutional Review” in 2008. The objective of the present study is to conduct an assessment of the spending and institutional changes in Bulgaria’s judiciary from 2008 onwards. The current report examines the principal trends in resourcing Bulgaria’s judiciary since 2008, while comparing the expenditure and judicial performance with those of other European countries. The impact of professional lobbyists varies according to context. The thesis assesses the relationship between professional lobbying and policy outcomes, and the impact of external variables. Whilst the effectiveness of professional lobbyists is partly a function of internal variables like skill, contacts and resources, external contextual factors are more often the key determinants of policy. Contextual variables include factors external to government like the world economy and judicial decisions, and factors internal to government including party ideology and the autonomy of government actors. Its four case studies (Sunday Trading, CrossRail, Jubilee Line Extension and Professional Liability), representing a range of issues, from high to low profile, and varying in degrees of technicality and politicality, test nine hypotheses against evidence from in-depth interviews, governmental and parliamentary papers, and the press. When context is favourable, lobbyists have the greatest effect on non-contentious, technical and non-partisan issues.
