O trabalho apresenta algumas reflexões sobre a história da formação do acervo acadêmico dos cursos jurídicos do Brasil criados no século XIX, especificamente da Faculdade de Direito da Universidade de São Paulo. A primeira Biblioteca Pública de São Paulo, fundada em 1825, exerceu forte influência para que o Convento dos frades franciscanos recebesse a escola de direito criada por Decreto Imperial, em razão de seu fundo bibliográfico de 5.000 mil livros, preponderantemente de cunho eclesiástico, e considerável para os padrões culturais do Brasil à época. Atualmente configura-se como uma importante biblioteca jurídica acadêmica da América Latina e, ao longo da sua história tem sido uma instituição de depósito moral, isto é, recebe doações das mais diversas localidades do país, encaminhadas espontaneamente pelos autores para ter sua obra disponibilizada no acervo do primeiro e um dos mais tradicionais cursos de Direito do Brasil. Atualmente, este acervo está estimado em aproximadamente 400 mil itens, com doações de personalidades brasileiras. O objeto deste estudo é a justiça eclesiástica, analisada sob dois aspectos: as relações estabelecidas pelos juízes eclesiásticos com os fiéis e com os juízes seculares; e os mecanismos de coerção que pôs em prática. A metodologia comparativa baseou-se nas seguintes fontes: processos judiciais eclesiásticos; recursos de averiguação de delitos - as querelas, queixas e denúncias; norma jurídica - expressa nas constituições sinodais, Ordenações e tratados; correspondência de bispos e governadores do século XVIII. Tais fontes evidenciam as várias facetas da justiça colonial: a virtude primeira do Príncipe; e a prerrogativa episcopal. Ponto central na evangelização tridentina, a justiça eclesiástica preconizava maior presença no cotidiano dos fiéis, e uma busca dos pecadores públicos, mediante devassas, denúncias, queixas e querelas. In the tumultuous political environment of late fifteenth- and early sixteenth-century Britain, animal literature saw rapid development and innovation. Beast fable and epic, which already had a long tradition in Latin and French, gained new vigor and popularity in English and Scots renditions. Simultaneously, a new strain of political theory appeared in the vernacular. This dissertation makes a tripartite argument about the relationship between these two discourses. First, writers of literature and political theory alike struggled to reconcile an optimistic view of human society, inherent in the prevailing philosophical tradition of natural law, with the widespread corruption they witnessed in ecclesiastical and royal courts. The fruits of this struggle were darkly humorous works of beast epic and fable in the former case, and pragmatic political theory in the latter. Second, because of its literary character, beast literature actually proved more adventurous than political theory in demonstrating how one might use dissimulation to dominate the predatory world of politics, and in showing the moral and linguistic exhaustion that could result from such manipulation of others. In Brazil, constitutional clauses regarding religious freedom have concrete applications in Private Law. Church-State Law, or "Ecclesiastical Law of the State," studies the legal principles which may be applicable to religious activity, exercised individually and collectively. The study of Church-State Law in Brazil lacks a thorough introduction to the constitutional and civil aspects of religious organizations: such an introduction is the main end of this work. Following a brief introduction, the main aspects of religious freedom and the principle of private autonomy as it concerns religious organizations are explained. A careful introductory analysis of Church-State Law in Brazil is thus developed: (1) the historical aspects, including a detailed account of the relations between Catholicism, the established religion up to 1889, and the government; (2) the current constitutional principles, as presented in the text of the federal Constitution of 1988, regarding the rights and claims of religious organizations; (3) how the same constitutional principles are to be used in the interpretation of Private Law (especially the Civil Code of 2002), fostering and preserving the uniqueness of religious organizations in the Brazilian legal system. This study deals with the formation, reproduction, and the role in litigation of two branches of the legal profession, lawyers and procurators. They were the experts in charge of civil, criminal, and ecclesiastical litigation during the Old Regime. While the lawyers provided erudite legal advice, procurators oriented and drove the procedure as legal representatives of their clients. The European legal revolutions of the twelfth and thirteenth centuries forged a new legal culture in which the lawsuit was reputed to be the best way to settle disputes. Likewise, that legal culture conferred an important place to specialists as legal facilitators of the contending parties. When Castilians exported their legal system to the New World, they spread a complex and bureaucratic framework, contributing to the reproduction of a class of experts in urban spaces.^ Lima and Potosi, two urban centers created in the sixteenth century, quickly became significant ‘legal cities’. This dissertation explores how the legal markets of these cities operated, the careers of their specialists, their professional options, social images regarding them, and litigation costs. [Resumen] El artículo tiene por finalidad analizar, particularmente en clave jurídica, la primera carta de Cipriano; en ella se menciona la prohibición establecida en un concilio anterior, de nombrar a los clérigos como tutores y curadores en un testamento y se aplican las sanciones eclesiásticas a un caso concreto. Se estudia también la eficacia de dicha prohibición en el ámbito de la legislación civil de su época así como las razones que pudieron llevar a la iglesia africana a establecer tal prohibición.; [Abstract] The paper studies, above all juridically, the first Cyprian’s Epistulae. The letter contains the prohibition, established in a previous council, on appointing a presbyter as guardian or procurator in a testament. Breach of promise of marriage suits originated in the ecclesiastical courts; the Hardwicke Marriage Act, however, invalidated betrothals and forced jilted lovers to use the common law courts for redress. This study is based on 875 breach of promise cases in England and Wales between 1750 and 1970, most of which occurred between 1850 and 1900. Lower-middle and upper-working class couples had a definite set of courtship rituals, based on their desire for respectability and their simultaneous lack of economic security. Though most couples wanted to find the companionate ideal, they also needed to have good homemakers (for men) and solid providers (for women). They indulged in middle-class sentimentality in their letters and poetry, yet their courting was less formal and unsupervised. This mixture of needs was also reflected in their motives for separating, a combination of ideological, structural and personal difficulties. There was a sustained argument over breach of promise in the later Victorian period, which showed the tensions between individualism and companionate marriage in its culture. As leis da cidade fundam-se em uma lei eterna, que exprime a arte e a sabedoria divinas. O supremo soberano, Hoh ou Metafísico, detém o poder espiritual e temporal. Ele é ao mesmo tempo governante, cientista e sacerdote. A identificação do conceito de direito em A Cidade do Sol, as fontes das leis da urbe e os princípios norteadores de seu ordenamento jurídico deu se a partir do sistema penal e processual da cidade, dos usos e costumes imaginários dos habitantes, do sistema e forma de governo, das noções de Estado e indivíduo, autoridade e livre arbítrio e propriedade e trabalho. El artículo presenta la legislación canónica sobre la sepultura eclesiástica. Expone las disposiciones canónicas del hecho de la muerte cristiana, haciendo alusión también a las litúrgicas. La tesis se orientó a comparar la normativa incluida en los dos códigos de derecho canónico. El presente documento se refiere particularmente a los casos en los que la iglesia concede o niega la sepultura eclesiástica con especial mención al Codex Iuris Canonici de 1983. Se tomó en consideración la legislación emanada después del código de 1917, la cual influyó en la conformación de la actual reglamentación. El tema no ha sido agotado, quedan algunas cuestiones pastorales relativas al caso de los familiares, quienes deben afrontar la situación cuando la iglesia priva de la concesión de las exequias a su pariente difunto.

The paper presents some reflections about the history of formation of Brazilian law schools libraries in the 19th Century, in special, those of the University of São Paulo Law School library. The first Sao Paulo Public Library, founded in 1825, was important in the decision to transform the Convent of the Franciscan friars into a Law School, created by an Imperial Decree, because of its bibliographic fund of 5.000 books, mostly about ecclesiastical subjects, was considered very proeminent for Brazilian cultural patterns at the time. This has been qualified as an important academic law library in Latin America and has been a “moral depository” throughout its history, because it has received donations of authors from various locations around the country, which aimed their works available in this library. Currently, this fund is estimated at approximately 400.000 items, included donations made by public personalities. Another subject is about the establishment of criteria for selection of material - editorial board, authors, relevance of the subjects etc. - caused by the editorial boom occurred in the 1990s, concomitant with the increase of law schools in the country. The challenge is the Roman Catholic Church's need for a bit more aggiornamento in the ecclesiology of parochial ministry. The persistent priest shortage has been met with provisional solutions, harboring hopes that increased ordinations of new presbyters would replenish the altars now empty. The restoration of the deacon in the United States has resulted in ordination of nearly eighteen thousand older Caucasian men to a service more attuned to the subordinated liturgical diaconate that fell into extinction a millennium ago. Instead, I believe that the model of the first deacons called to serve by the apostles to steward the temporal administration of the church shows this order's true calling, as personified by the great service of their medieval archdeacon successors. The challenge is to draw from this history a theology intended for the diaconate, seek out its canonical limitations and establish a new ecclesiology ready for implementation in praxis today.

In this work I will first explore today's challenges to ministry in the Roman Catholic Church in the United States and the circumstances surrounding the priest shortage. A brief quantitative analysis of the church and its ordained ministers will be contrasted to the sociological trends they paralleled. Then the historical church legislation and the leaders that influenced it will be examined to ferret out theological and canonical possibilities and limitations for the restored diaconate's service. Parallel to the possession of property, although distinguishable from it, is the right of the Church to receive offerings from the faithful for its own maintenance. In this article I will reflect on the fact that the law in apartheid South Africa required different procedures for the Dutch Reformed Mission Church and the Dutch Reformed Church in Africa regarding property and finances. Attention will be given to the principles in ecclesiastical law and common law with regard to ecclesiastical property. Secondly, attention will be given to who has the right to control ecclesiastical property, as well as to the quest of vested rights in the case of schism, unification and dissolution. Lastly, I propose that ecclesiastical property and financial matters require basic knowledge of ecclesiastical law and common law.
