A presente pesquisa tem por pano de fundo o debate sobre a legitimidade do processo de integração da Europa, iniciado na década de 1950. Uma das principais expressões desta seara corresponde ao contemporâneo tema das assimetrias entre as expectativas das populações nacionais sobre a condução do processo de integração e o procedimento decisório verificado na praxis comunitária. O variado rol de limitações à ação participativa dos cidadãos no cerne deliberativo da União Europeia é reunido doutrinariamente sob a alcunha de déficit democrático. Mote frequente das análises de Filosofia Política e assunto recorrente dos estudiosos de Relações Internacionais, a existência de um déficit democrático na principal iniciativa de integração regional da Europa encontra escassos trabalhos sedimentados em uma abordagem jurídica. Deste modo, o principal escopo deste estudo é aclarar de que forma o Direito contribuiu para o advento do déficit democrático europeu e como são articuladas, pela via jurídica, as tentativas atuais de combate a este fenômeno. O presente estudo propõe-se a investigar o potencial de o projeto de democracia cosmopolita, tal como formulado por David Held, Anthony McGrew e Daniele Archibugi, suprir o déficit democrático das instituições representativas brasileiras decorrente dos fenômenos da globalização e do policentrismo do poder, no contexto da atual crise econômica mundial. Trata-se, pois, de se contrapor o modelo cosmopolita, de caráter transterritorial, ao modelo representativo, de base territorial. A regulação financeira, especialmente a regulação bancária, tem um papel central na organização da vida social. As modernas técnicas regulatórias, altamente sofisticadas, são o resultado de décadas de evolução. Elas exigem técnicos especializados, orçamentos específicos e uma estrutura institucional complexa. Mais que isso: para promover as regulações sistêmica e prudencial, os reguladores necessitam de amplos poderes normativos uma capacidade normativa de conjuntura. A atribuição de tais competências a órgãos que não contam com a legitimidade das urnas é considerada por alguns autores uma espécie de anomalia no direito constitucional. Para outros, ao contrário, ela é um elemento necessário do desenho institucional do Estado Regulador contemporâneo. É nesse ponto que se cruzam os debates sobre o processo de burocratização da vida social e sobre o desenvolvimento dos cânones do direito ocidental, especialmente a doutrina da separação dos poderes. Mestrado em Ciência Política; Para muitos autores, como Soares(1997) e Hix(2005), a União Europeia sofre de um défice democrático, que se traduz, entre outros aspectos, por uma insuficiente participação dos cidadãos europeus no sistema político comunitário, ou seja, existe um desequilíbrio entre a concepção teórica de funcionamento da União Europeia (especialmente pós-Tratado de Lisboa), e a efectiva capacidade de participação dos cidadãos europeus junto dos organismos da União. The subject of the present paper is the state of linkage between society and politics in the European Union (EU). In this field, political science is a science of democracy: the democratization of the EU is a ubiquitous issue. We therefore begin with a clarification of the notion of a ”democratic deficit” in the European Union. In the second and third parts, we address questions of interest intermediation and opinion formation. Hopeful of bringing citizens closer to government decision-making Gary Humphries recently presented the Community Referendum Bill 2002 to the AGT Legislative Assembly. The Citizen Initiated Referendum has many staunch advocates however this paper considers whether CIR is an appropriate solution to perceived democratic deficits in the ACT or anywhere else in Australia. The paper canvasses a number of pitfalls of CIR. These include: their potential to aggravate rather than ameliorate the democratic deficit; the problems associated with under-deliberation; and potentially detrimental consequences for existing electoral arrangements. There is a longstanding debate on the EU’s democratic deficit. Recently, the EU has responded to this by, for example, including the idea of participatory democracy in the Lisbon treaty. This corresponds to first experiments with means for citizens’ participation that are rooted in the idea of participatory and deliberative democracy and supported by the EU Commission. In contrast to interest group politics, these attempts aim at including ‘normal’, i.e. non-interested and unorganized citizens into policy-making. Examples of such ‘democratic experimentalism’ are the citizens’ deliberation ‘Meeting of Minds’ or the European Citizens’ Consultations on Europe’s future. The objective of the paper is to discuss these models and their specific problems against the background of the general democratic deficit debate. The key questions are: Are these examples ‘best practices’? What are their effects? Political parties in government usually tend to resist to the politicization of European issues, through hollowing out the European dimension from political competition. As a supranational political system, the question of the democratization of the EU political process has only been considered recently. The debates around the notion of democratic deficit have tried to grasp the gradual divorce between elites and citizens. This article defends that the tendency to exclude European debates from the traditional left-right ideological dimension of political competition has indirectly reinforced the sociological cleavage between European elites and national citizens. The democratic deficit of the European Union is directly related with the tendencies to depoliticize the democratic process, and with the progressive construction of a European constitutional pillar without the parallel institutionalization of a popular pillar. The debate is more linked with the modalities of exercise and of control of political power at the European level, than with the extension of the rights and liberties of European citizens. Moreover, it is not the idea of a united Europe which is generally contested, but rather, the quality of political representation at the EU level and the possibilities to influence and control European policies. A great deal of the dilemma has to do with the prevalence of new modes of governance which tend to exclude political competition from the democratic process to the benefits of non-majoritarian institutions and mechanisms which remain apart from conventional representation and electoral responsibility.

In the present paper I take a critical view on the well-known discursive dilemma which captures the difference between governance by collective reasoning or governance responsive to majoritarian will. Then I suggest the republican concept of collective reason as a new perspective for study of EU and analyse the European Union as an example of a system which collectivises reason. From such perspective the notorious democratic deficit is explainable as the contradiction between collective reason and popular will. This problem brings home the conclusion that neither collectivising reason nor responsiveness to majority will alone can fully satisfy our normative demands. Thus, I claim that it is necessary to find a way out of the dilemma by a decision-making process that can bring about the two solutions in the same time. I suggest that in polities where people (as individuals) identify with the people (as a group) the gap is closed by a stepwise process of deliberation in the public sphere. Paneuropean deliberation is possible solution for Europe but in practice is obstructed by the competition from the spontaneous deliberation in the existing national public spheres. The latter are more robust, so they close the rationality gaps faster at national level; national public opinions tend to polarise and defend a ‘national’ interest against further deliberative challenges. In classical party democracy, elections serve as an “instrument of democracy” (Powell 2000): they are the mechanism to connect policy preferences of the electors (within the electoral arena) to the political production (within the legislative arena). At the European level the linkage seems to be lost because the political actors performing in the two arena are not the same and the logics of behaviour are quite different. The EU calls for truly “Europarties” to become more democratic in its procedural and substantive prerequisites and this entails not only a progressive emancipation of party structures at European level but also an integration between them. In fact, we will have full Europarties only when the two party structures at EU level are either independent from national parties and linked to each other: if intra- and extra- parliamentary faces become really European and connected entities, legislators will be accountable to voters and, consequently, democratic deficit will decline. The last European elections of 2014 were characterized by a concrete effort to increase public participation to the European political debate. However the overall electoral turnout remained disappointingly low. In this paper I deal with the problem of the formation of a European electorate and argue that a better representation on the European integration dimension should substantially contribute to the formation of a transnational electorate. Often, there is the fear that European political conflict framed on this dimension would lead to a radical bipolar conflict between pro- and anti-EU parties. In this paper I show that, if citizens’ preferences are properly represented, this does not have to be the case. What I show is that citizens’ preferences on European integration are distributed in three roughly equivalent blocs: pro-EU, anti-EU and a neutral position. The point I make is that a proper representation of the neutral position should ensure that the conflict does not become too radical, as the parties representing the neutral position would be the necessary coalition partners of both pro- and anti-EU parties. An important shortcoming of the current European parliament, I argue, is that the neutral position on European integration is not represented and that consequently there is a disproportionate high presence of pro-EU parties. This misrepresentation in the long run may increase the public appeal of Euro-sceptic parties. The data on which my argument is based are from the 2014 Eurobarometer survey.

I identify a problem with the solution preferred by the republican theory which I call the rationality gap and suggest that in principle deliberation in the public sphere may bring the two ends together, thus avoiding the gap. O presente trabalho consiste em um estudo empírico com abordagem qualitativa cujo objetivo é, a partir do estudo de caso do processo de licenciamento ambiental da Usina Termoelétrica de Canas/SP, compreender concretamente os instrumentos de participação pública disponíveis em sua articulação em um procedimento estabelecido, bem como identificar o potencial e o déficit democrático do processo de licenciamento ambiental. A partir da análise de um caso específico, a dissertação apresenta as relações e as interações sociais que se dão no âmbito de um processo normatizado que tem por finalidade culminar numa deliberação pela administração pública. The rejection of the Constitutional Treaty and the various events following the negative referenda provide an excellent occasion for reconsidering the real meaning of European integration. Paradoxically, the integration process is often praised for its clumsy and ultimately unsuccessful attempts to mimic the nation state, while its truly important contribution to European civilization - the establishment of a supranational constitutional order - is belittled or even ignored. An example of this distorted vision is the debate on the so-called democratic deficit - a condition which could be easily corrected if a majority of Europeans supported a supranational federal state. Since it is obvious that no such majority exists, now or in the foreseeable future, the 'democratic deficit', however defined, is the price we pay for wishing to integrate our national economies while preserving the core of national sovereignty. The current crisis is methodological rather than systemic: it amounts to a rejection of the stealthy approach to European integration - cryptofederalism - which has entailed the triumph of process over outcome. Graves problemas como el déficit democrático y la falta de una inclusión mayor de los ciudadanos a los procesos de integración amenazan la unidad europea. La gobernanza multinivel y el principio de subsidiariedad no han creado un sentimiento de identidad con los ciudadanos. Em decorrência da globalização, o Estado perdeu o monopólio da mediação política. Por exemplo, passou a compartilhar decisões com múltiplos atores, internos e externos, e não é capaz de controlar diversas variáveis que interferem na vida nacional. Isso tem impactos sobre o funcionamento e a legitimidade das instituições representativas. Restrictions to the range of policies available to governments are often recommended as a solution to coordination failures or time inconsistency problems. However, policy restrictions can have important drawbacks that have been generally ignored so far. When the hands of governments are tied, citizens have lower incentives to be informed on political matters and to participate in collective decision-making processes, since private returns from political information are lower. This mechanism provides a micro-foundation for the idea that the so-called "democratic deficit" induces low participation in political life. Moreover, a fiscal policy restriction tends to reduce redistribution by inducing lower political information acquisition by part of poorer voters. We show that an exogenous restriction on the amount of public good that a government can supply (or on the taxes that can charge) may induce less public good supply (less taxation) with respect to its no-restriction level, independently of whether the restriction imposes a maximum amount, a minimum, or both. Perversely, the equilibrium outcome can be very different from what the restriction intended to achieve.

In the nineties, Habermas redirected his political writings to the post-national constellation (global and European) and the possibilities of a society politically integrated through transnational democracy (or post-national democracy). This thematic reorientation took place on two fronts. The first one is the global transnational democracy, which includes the impacts of the economic globalization on national democracies, as well the proposal for a political Constitution for a pluralistic world society, based on a constitutionalization of international law. The second one is the European transnational democracy, which includes the redefinition of the political profile of European welfare state for an economic liberal profile, as well the paradox of democratic technocracy operated by European institutions and the proposal to overcome the decoupled technocratic policy model. This paper will address only this last topic, describing the reasons of the democratic deficit and the consequent delay of European political Union. Despite numerous reforms, the technocratic policies have not eliminated the discrepancy between centralization and democratization, and mistakenly indicate another direction further reinforcing the problem of European undemocratic institutions.
