Esta tese de doutorado estuda os requisitórios: precatórios e requisições de pequeno valor, sob o prisma do Direito Financeiro. Com esse objetivo se estuda o desenvolvimento dos requisitórios e suas regras atuais, tanto em termos de determinações constitucionais, quanto nas questões orçamentárias, da dívida pública e do controle das finanças públicas, questionando também a forma como se dá a execução contra a Fazenda Pública por quantia certa em outros países do mundo.; This doctoral thesis studies, through the prism of Financial Law, the payments of money owed by the Federal Treasury, by State Treasury, by Federal District Treasury, or by Municipal Treasury, by virtue of a court decision (writ of execution against Public Treasury or writ of execution of a small amount of money against Public Treasury). For this purpose we study the development of payments of court decisions and its current rules, both in terms of constitutional provisions, budget issues, public debt and internal and external audit of public money used to pay court decisions, also questioning how this payment is done by Public Treasury in other countries.

Atualmente, no meio jurídico, há um reconhecimento implícito de que as provas materiais necessitam de embasamento científico para alcançar a autenticidade imprescindível ao estabelecimento da convicção dos magistrados. A natureza de determinados exames, como a classificação de substâncias proibidas, demandam a utilização de técnicas e saberes oriundos das ciências naturais e tecnológicas. O trabalho pericial deve ser pautado pela cientificidade, com a aplicação de conhecimentos de diversas áreas, dentre as quais está incluída a estatística forense. Neste trabalho foram utilizadas ferramentas estatísticas para avaliar a qualidade e a contribuição dos laudos periciais para os casos envolvendo substâncias ilícitas e correlacionar o conteúdo destes documentos com a sentença judicial. Numa primeira etapa foram analisadas as informações contidas em laudos toxicológicos de drogas, com o intuito de quantificar a qualidade e importância que eles poderiam fornecer em um processo. Para isso foram analisados 1008 documentos oficiais de diversas jurisdições, divididos em 504 conjuntos de laudos preliminares e definitivos do mesmo caso forense A intenção foi apreciar um conjunto heterogêneo de documentos para possibilitar uma melhor análise. Buscou-se neste trabalho examinar a jurisprudência da Suprema Corte dos Estados Unidos da América acerca da modulação dos efeitos de uma decisão de inconstitucionalidade. Para tanto, foram analisados os casos Mapp v. Ohio (1961), Linkletter v. Walker (1965) e Stovall v. Denno (1967). Após, buscou-se examinar a jurisprudência do Supremo Tribunal Federal da República Federativa do Brasil acerca do mesmo assunto. Para tanto, foram analisados os casos do Recurso Extraordinário no 197.917, da Segunda Medida Cautelar em Petição no 2.859 e do Habeas Corpus no 82.959. Em seguida, tomou-se posição a respeito da pretensão de correção dos principais pontos da fundamentação apresentada nos casos brasileiros. Concluiu-se o trabalho com a constatação de que a Suprema Corte admitiu a modulação com base em critérios distintos para a área criminal e para a área cível; porém, depois de um tempo, abandonou a possibilidade de modulação em ambas as áreas. Nas últimas décadas, em função das atribuições conferidas pela Constituição Federal de 1988 ao Supremo Tribunal Federal, as pesquisas sobre Judiciário passaram a examinar essa instituição a partir de perspectivas próprias da Ciência Política. Partindo da ideia de que as decisões dos ministros não consistem em mera atividade formal, de subsunção do fato à norma posta, mas por vezes interferem na arena política, essas pesquisas procuram delinear o papel político exercido pela Corte e apresentar o padrão decisório dos ministros no tocante a temas diversos, através da análise empírica de suas decisões. The article discusses the present status of weblogs and examines whether legal standards applicable to traditional press and media should be applied to that specific forum. The analysis is based on two key documents: the Draft Report on the concentration and pluralism in the media in European Union (2007/2253(INI)) of the European Parliament Committee on Culture and Education presented in March 2008 and a landmark decision of the Polish Supreme Court from July 26, 2007 (IV KK 174/07) in the light of present judicial tendency in other European countries. The first of the mentioned documents calls for the “clarification of the legal status of different categories of weblog authors and publishers as well as disclosure of interests and voluntary labelling of weblogs”. It emphasizes that the “undetermined and unindicated status of authors and publishers of weblogs causes uncertainties regarding impartiality, reliability, source protection, applicability of ethical codes and the assignment of liability in the event of lawsuits”. This report complements the Serbia Judicial Functional Review, which assesses the current functioning of the broader judicial system in Serbia and outlines options and recommendations to inform Serbia s ongoing and planned justice reform initiatives in the view of EU accession.1 The aim of this report, however, is to illustrate the steps court users take in order to protect their interests through procedures carried out by courts or bailiffs. The World Bank assessed the insolvency and creditor or debtor regimes (ICR) of Moldova pursuant to the joint international monetary fund (IMF) and World Bank initiative on the observance of standards and codes (ROSC). The Moldovan authorities have made remarkable progress over the last decade in taking on board a broad range of reform related to the commercial law regime, including the laws pertaining to creditor protection and insolvency. Loans are often over collateralized, reducing available credit and increasing the incentives for lenders to rely primarily on their collateral for repayment rather than to support restructuring efforts. The secured transactions regime requires improvement, importantly regarding the facilitation of important credit instruments over category of assets. The rules aimed at encouraging good corporate behavior at times of financial distress may be improved and obstacles on insolvency filing by creditors removed to ensure timely filing of insolvency proceedings. This paper considers the historical origins and efficacy of enforcement of civil court judgments, with a special focus on court auctions. It reviews the procedural and practical options available to courts and associated agencies for the identification of assets that may be used to satisfy a judgment debt and the processes for court-supervised asset seizure and sale by public auction. The efficiencies of public court auction processes are considered, including the elements of enforcement systems that can produce sub-optimal returns on sold assets and higher incentives for corrupt practices. Also considered is the trend in some systems for greater use of private agents as a means by which the cost of court enforcement processes can be reduced and for overcoming sometimes lengthy delays in enforcement. The paper concludes by identifying alternatives to public auction that in some cases can offer better prospects of assuring full payment of a judgment debt.

This dissertation examines the behaviour of the Supreme Court of Canada in cases involving electoral/referendum laws and the alleged violation of freedom of expression and/or the right to vote. In 2007, it declared that the judiciary should adopt "a natural attitude of deference" towards Parliament's decisions about the democratic process when determining, under section one of the Canadian Charter of Rights and Freedoms, whether the infringement is reasonable and justified. This declaration reflected institutional concerns about judicial competence to review legislative choices in this area of public policy and the democratic legitimacy of it doing so. It was made even though the Court had found laws unconstitutional in a majority of the cases that it had heard to date. Deference is often simply equated with government 'wins' in court. Such an equation ignores the effect that the decision has on judicial reasoning. It sets the standard of review the court uses when applying the Oakes test, the framework within which the section 1 analysis occurs. This dissertation describes and analyzes the work of the Supreme Court of Canada, emphasizing its internal environment and processes, while situating the institution in its broader governmental and societal context. In addition, it offers an assessment of the behavioural and rational choice models of judicial decision making, which tend to portray judges as primarily motivated by their ideologically-based policy preferences. The dissertation adopts a historical institutionalist approach to demonstrate that judicial decision making is far more complex than is depicted by the dominant approaches within the political science literature. Drawing extensively on 28 research interviews with current and former justices, former law clerks and other staff members, the analysis traces the development of the Court into a full-fledged policy-making institution, particularly under the Charter of Rights and Freedoms. This analysis presents new empirical evidence regarding not only the various stages of the Court’s decision-making process but the justices’ views on a host of considerations ranging from questions of collegiality (how the justices should work together) to their involvement in controversial and complex social policy matters and their relationship with the other branches of government. These insights are important because they increase our understanding of how the Court operates as one of the country’s more important policy-making institutions. The present article looks at the basic components of the structure of the argument justifying the application of constitutional precedent Colombia, through the reconstruction of Constitutional Court decision T292, 2006, which is a key ruling on the issue. It begins by placing the question in context and looking at its current state, in addition to providing a brief description of Colombia’s constitutional system and the use of judicial precedent within it. After that, the classical notions and the current ones on the binding nature of decisions on constitutionality are presented. However, although the emphasis is on abstract constitutional control, several clarifications are provided on rulings that resolve writs for the protection of fundamental rights. Concepts and features that are crucial to the purpose of this article are summarized as well, such as the workings of vertical and horizontal precedent, and the change in the line of decision, all within the framework of Colombian constitutional jurisprudence. The Latham Court’s constitutional decision-making was characterised by stark contrasts: deference to parliament and the executive during World War II followed by a vigorous approach to judicial review in the post-war period that saw the demise of key parts of the Chifley Government’s policy platform. Remarkably, the Court executed this dramatic shift in approach without significant damage to its legitimacy as independent arbiter of the Constitution. In this regard, the Latham Court exemplifies Galligan’s thesis that, for much of last century, the High Court used legalism as a shield to discharge its ‘delicate political function’ of judicial review ‘without becoming embroiled in political controversy’. Behind this commitment to legalism the Justices and the Labor Government were well aware that, in interpreting the Constitution, the Court was also a political body. While it is important not to overstate this point – the Latham Court’s opinions adhered to legal norms – this essay explores key aspects of the political life of the High Court in this tumultuous period of war and peace. Many law professors and scholars think of the Supreme Court as a black box--issues and arguments go in to the Court, and decisions come out. The almost mystical nature that these researchers impute to the Court seems to be a function of the lack of hard data and statistics about the Court's decisions. Without a robust dataset from which to draw proper conclusions, legal scholars are often left only with intuition and conjecture.

Explaining the inner workings of one of the most important institutions in the United States using such a subjective approach is obviously flawed. And, indeed, data is available that can provide researchers with a better understanding of the Court's actions, but scholars have been slow in adopting a methodology based on data and statistical analysis. The sheer quantity of available data is overwhelming and might provide one reason why such an analysis has not yet been undertaken.

Relevant data for these studies is available from a variety of sources, but two in particular are of note.
