O presente trabalho objetiva analisar a oferta pública para aquisição do controle de companhia aberta, na França e na União Europeia, sendo que, ao longo do seu desenvolvimento, serão feitas comparações pontuais com o direito brasileiro. Na conclusão, serão apontados aspectos relativos à disciplina da matéria analisada à luz do direito estrangeiro que possam ser adaptados e adotados pelo direito pátrio, bem como aspectos deste último que possam ser aproveitados pelo direito estrangeiro. O presente trabalho investiga os impactos das licitações do tipo menor preço, realizadas por meio de Pregão eletrônico, no desempenho das execuções dos contratos contínuos, efetivados pela Superintendência de Administração da AGU em Pernambuco - SAD/PE -, no período de 2006 a 2010. Teve como proposição a premissa de que a contratação do tipo menor preço pode, em função de suas próprias características, estimular uma redução excessiva nos preços ofertados pelos licitantes e originar contratações com valores muito baixos que interferem de forma negativa no desempenho da prestação dos serviços, gerando infrações contratuais e diminuindo a vida útil dos contratos contínuos. A aparente economia, consequência da acirrada competição nos leilões invertidos, que caracterizam a modalidade licitatória Pregão, em médio e longo prazo, pode ser questionada. Os resultados confirmaram a proposição, evidenciando um percentual de 55% dos contratos, oriundos de Pregão eletrônico, com infrações e 31%, rescindidos unilateralmente por descumprimento de cláusulas contratuais. We used a script-fading procedure to teach 3 children with autism to initiate bids for joint attention. We examined the effects of (a) scripts, (b) varied adult scripted responses, and (c) multiple-exemplar script training on promoting unscripted language during bids for joint attention. All 3 participants learned to initiate bids for joint attention, and the response generalized to untrained stimuli, conversation partners, and the classroom environment.

Bidding has been proposed to replace or complement the administered prices in Medicare pays to hospitals and health plans. In 2006, the Medicare Advantage program implemented a competitive bidding system to determine plan payments. In perfectly competitive models, plans bid their costs and thus bids are insensitive to the benchmark. Under many other models of competition, bids respond to changes in the benchmark. We conceptualize the bidding system and use an instrumental variable approach to study the effect of benchmark changes on bids. We use 2006–2010 plan payment data from the Centers for Medicare and Medicaid Services, published county benchmarks, actual realized fee-for-service costs, and Medicare Advantage enrollment. We find that a $1 increase in the benchmark leads to about a $0.53 increase in bids, suggesting that plans in the Medicare Advantage market have meaningful market power.

Limited competition has been a serious concern in infrastructure procurement. Importantly, however, there are normally a number of potential bidders initially showing interest in proposed projects. This paper focuses on tackling the question why these initially interested bidders fade out. An empirical problem is that no bids of fading-out firms are observable. They could decide not to enter the process at the beginning of the tendering or may be technically disqualified at any point in the selection process. This paper applies the double selection model to procurement data from road development projects in developing countries and examines why competition ends up restricted. It shows that bidders are self-selective and auctioneers also tend to limit participation depending on the size of contracts. Therefore, limited competition would likely lead to high infrastructure procurement costs.

Asymmetric auctions are among the most rapidly growing areas in the auction literature. The potential benefits from improved auction efficiency are expected to be enormous in public procurement auctions related to official development projects. Entrant bidders are considered a key to enhance competition in an auction and break potential collusive arrangements among incumbent bidders. Asymmetric auction theory predicts that weak (fringe) bidders would bid more aggressively when they are faced with a strong (incumbent) opponent. Using official development assistance procurement data, this paper finds that in the major infrastructure sectors, entrants submitted systematically aggressive bids in the presence of an incumbent bidder. The findings also show that a high concentration of incumbents in an auction would harm auction efficiency, raising procurement costs. The results suggest that auctioneers should encourage fringe bidders to actively participate in the bidding process while maintaining the quality of the projects. This is conducive to enhancing competitive circumstances in public procurements and improving allocative efficiency.

Present regulatory trends are promoting the irect participation of wind energy in electricity markets. The final result of these markets sets the production scheduling for the operation time, including a power commitment from the wind generators. However, wind resources are uncertain, and the final power delivered usually differs from the initial power committed. This imbalance produces an overcost in the system, which must be paid by those who produce it, e.g., wind generators among others. As a result, wind farm revenue decreases, but it could increase by allowing wind farms to submit their bids to the markets together with a hydro generating unit, which may easily modify its production according to the expected imbalance. This paper presents a stochastic optimization technique that maximizes the joint profit of hydro and wind generators in a pool-based electricity market, taking into account the uncertainty of wind power prediction.

The World Bank undertakes assessments of the procurement environment, covering both public and private sectors, in borrowing member countries on a systematic basis. The objective of this assessment is to provide useful feedback to Borrowers regarding the strengths and weaknesses of their public procurement systems. This enables member countries of the Bank to improve the transparency of their procurement processes and to develop an Action Plan to enhance their capacity to conduct public procurement efficiently. A further important objective is to determine the compatibility of national procurement practices with the principles of economy and efficiency and with international procurement law and best practice. As a means to reduce delays in public works implementation, a number of Brazilian states have recently reformed their procurement rules allowing contractor price proposals to be assessed before the technical evaluation of submitted bids is undertaken (in a procedure known as inversao das fases). In order to evaluate the effects of such reform, this paper adopts a difference-in-differences methodology to compare the procurement performance of Sao Paulo state (a reformer state) and Minas Gerais' (a non-reformer state) largest water and sewage utility along three efficiency dimensions: (i) procurement process duration; (ii) likelihood of complaint resolution litigation; and (iii) prices paid to contractors. The analysis finds that the reform is associated with a 24 day reduction in the duration of procurement processes for large projects and a 7 percentage point drop in the likelihood of court challenges irrespective of project size. Several stakeholders in the Pakistan construction industry have expressed concern about the apparent poor response to recent international and local bids. The objectives of the study were to evaluate the level of response to recent international and local tenders and to assess the level of interest of international firms to bid on projects in Pakistan. The response to recent invitations to bid on projects across Pakistan has been poor from both international and local firms. Although, tendering was open to both international and local contractors, most firms that submitted bids have been local. Generally, the same set of four or so contractors repeatedly bid for projects across the country, and the lowest bidder always won the contract. There was apparently minimum weight-age given to an evaluation of the technical capability of the lowest bidder. Every year, the Philippine government spends hundreds of billions of pesos to buy the goods and services it needs to carry out projects and deliver services to its citizens. This money comes from the budget that it funds out of its own revenues and from loans and grants extended by foreign sources such as multilateral development banks and bilateral donors. Can governments be held accountable for spending by citizen organizations? In this issue the author present the experience of two civil society organizations (CSOs) engaged in budget and procurement review and monitoring in Nigeria. In the Nigerian context, the preconditions for accountable citizen-state relations are underdeveloped. In particular, some of the building blocks of transparent and accountable public financial management systems are absent or dysfunctional. Lack of information and limited opportunities for citizens' engagement in government processes have resulted in high levels of mistrust between citizens and government. Despite these challenges, there are people and groups, in both government and civil society, who have taken bold steps to ensure greater transparency and accountability in the planning and management of public resources. For example, networks of CSOs working in the area of procurement oversight have started demanding information on procurement bids. Once a government has decided to award a concession by auction, it needs to decide what kind of auction to use. For concessions the standard is a first-price sealed bid auction in which bidders submit sealed envelopes containing their offer and the highest offer determines the price. The bidding may occur in one or two stages. In two-stage bidding the technical parameters of the bids are made comparable in the first stage, and only the main offer on the core bid parameter is submitted in the second. The main offer may relate to a price, a level of subsidy, a payment for net worth, or any other appropriate parameter; the discussion in this Note focuses on price.

We consider the problem of auction design with agents that have interdependent values, i.e. values that depend on each others' private signals. We adopt the contingent bids model of Dasgupta and Maskin [3], and allow agents to submit bids of the form "if player 1 bids $x for good A then I will bid $y." Our main contribution is to identify a specific linear valuation model for which there exists an efficient auction for a single item, and then extend this to provide an approximately efficient combinatorial auction with single-minded bidders. In both auction, winners and payments are computed from the fixed point of the valuation mapping defined by contingent bids. We also adopt search in order to construct a variation on the single-item auction with improved revenue. A multiple baseline design across 3 children with autism was used to assess the effects of prompting and social reinforcement to teach participants to respond to an adult's bid for joint attention and to initiate bids for joint attention. Participants were taught to respond to an adult's bid for joint attention by looking in the direction of an object at which the adult pointed, by making a comment about the object, and by looking back at the adult. Additional training and reinforcement were needed to teach the participants to initiate bids for joint attention. Findings are discussed in terms of the social relevance of teaching children with autism to respond to and initiate bids for joint attention.

We report on the experimental results of simple auctions with (i) a median-bid pricing rule and (ii) non-binding bids (winning bids can be withdrawn) – the two central pillars of the competitive bidding program designed by the Centers for Medicare & Medicaid Services (CMS). Comparisons between the performance of the CMS auction and the performance of the excluded-bid auction reveal the problematic nature of the CMS auction. The CMS auction fails to generate competitive prices of goods and fails to satisfy demand. In all proposed efficiency measures, we find the excluded-bid auction significantly outperforms the CMS auction.

When a municipality contracts for goods or services, it must make use of competitive bidding / a public call for tenders for contracts over R200 000 as well as for long term contracts. A competitive bidding process generally consists of different stages, for example, compiling bid specifications, advertising the bid, the receipt and evaluation of bids, and the award and implementation of the contract. The Municipal Supply Chain Management Regulations require a municipality's Supply Chain Management Policy to provide for a committee system to oversee the different stages. Such committee system must, moreover, consist of at least a bid specification committee, a bid evaluation committee and a bid adjudication committee. Until recently, little attention has been given by the courts to the roles and composition of the different committees in the committee system. It is only after government, and in particular, municipalities have begun to implement the committee system in their procurement processes that it is evident that problems are arising. In recent months, the courts have increasingly had to deal with issues pertaining to the implementation of the committee system. In this article, the relevant legislative provisions on the committee system for competitive bids in local government are discussed. The functions of each committee are explained and all the cases that have thus far involved the implementation of the committee system are critically analysed. Much attention is given to the cases since they serve as a warning to municipalities to uphold and comply with the rules relating to the roles and composition of the different committees. The cases illustrate how important it is for municipalities to ensure that the different committees are properly constituted and that decisions at meetings are properly taken. They also highlight the importance of the supervisory role of the municipal manager over the different committees. In light of the cases it is clear that failure to comply with all the legislative requirements results in very costly litigation.
