This document provides an assessment of the public procurement system in Sindh province using the baseline indicators system developed by the Development Assistance Committee of the Organization for Economic Cooperation and Development (OECD-DAC). This assessment, interviews and discussions were held with stakeholders from the public and private sectors as well as civil society. Developing country governments and donors have a mutual interest in increasing the effectiveness, efficiency, and transparency of procurement systems. Both have worked together under the auspices of the World Bank and OECD-DAC procurement round table initiative to develop a set of tools and standards to support and guide improvements in procurement systems. These tools include: (i) benchmarking for assessing the structure of public procurement systems, and (ii) monitoring and evaluation of public procurement systems. A key analytical tool developed for benchmarking is the baseline indicators system which comprises four pillars: 1) the legislative and regulatory framework; 2) institutional framework and management capacity; 3) procurement operations and market practices; and 4) integrity and transparency of the public procurement system.

The North West Frontier Province (NWFP) is the third largest province of Pakistan. The developing countries and bilateral and multilateral donors having a concern for increasing the effectiveness, efficiency and transparency of procurement systems, under the auspices of the joint World Bank and OECD Development Assistance Committee (DAC) Procurement Round Table initiative, worked together to develop a set of tools and standards that provide guidance for improvements in procurement systems and the results they produce. Among these tools are included: (i) Benchmarking for the assessment of the structure of the public procurement systems; and (ii) Monitoring and Evaluation of the public procurement systems. With regard to the first deliverable a tool comprising a set of baseline indicators for the assessment of a country system has been developed. This tool comprising four pillars explained through twelve (12) indicators.

This handbook is intended for government employees involved in public procurement. It provides some insights into how fraud and corruption schemes work in public investments. The handbook identifies a range of fraud and corruption indicators, or red flags, and relevant schemes that may become apparent during the life of an investment, from design to implementation. The primary focus of this handbook is fraud and corruption in procurement, with some coverage of general governance issues. It is based on the experience of Poland s Central Anti-Corruption Bureau and the World Bank s Integrity Vice Presidency, and it presents examples referring both to public investments implemented under Polish public procurement law and international competitive bidding. This handbook aims to provide support to the managers of procuring entities in conducting public procurement by identifying frequently occurring irregularities and suggesting methods of preventing them.

The local case studies for projects in different sectors were prepared to document the bottlenecks which occurred during the various processes involved in the life cycle of infrastructure projects. Identifying such processes allows a better understanding of the capacity constraints in planning, designing, programming, procurement, contract administration, financing and budgeting, execution, and other stages in a project cycle. The case studies clearly demonstrate the presence of deep rooted systematic problems related to: (1) inadequate client capacity to plan, procure, program, administer, and manage projects; (2) imbalanced conditions of contracts; (3) flawed procurement procedures (pre-qualification, bid evaluation, negotiations, and re-negotiations with the lowest bidder) causing significant delays; (4) mismatched project funding needs and actual availability of funds; (5) commencement of projects without ensuring that required funds are in place; (6) delay in making running payments; (7) insufficient time given for detailed design and variations in contract due to inadequacies in design; (8) limited capacity of local contractors; and (9) poor international bid response in mega projects related to credibility issues.

Borrowing countries are increasingly inclined to use electronic procurement systems and means for processing and managing MDB funded activities. This guide is intended to be used for the application of e-reverse auctions during the procurement process. Not all procurement is suitable for e-reverse auction. Some governments consider e-reverse auction to be a special case of e-bidding while others see it as part of e-Purchasing. The second public expenditure management and financial accountability review (PEMFAR II) report provides analysis of the fiscal space outlook, a review of public expenditure management, including of the public investment management system, and assessments of the public financial management and public procurement systems. Infrastructure projects are often technically complicated and highly customized. Therefore, procurement competition tends to be limited. Competition is the single most important factor toward auction efficiency and anti-corruption. However, the degree of competition realized is closely related to bidders' entry decision and the auctioneer's decision on how to assess technical attributes in the bid evaluation process. This paper estimates the interactive effects among quality, entry, and competition. With data on procurement auctions for electricity projects in developing countries, it is found that large electricity works are by nature costly and can attract only a few participants. The limited competition would raise government procurement costs. In addition, high technical requirements are likely to be imposed for these large-scale projects, which will in turn add extra costs for the better quality of works and further limit bidder participation. The evidence suggests that quality is of particular importance in large infrastructure projects and auctioneers cannot easily substitute price for quality.

This Country Procurement Issues Paper (CPIP), is an interim assessment of the public procurement system of The Gambia based on the self-evaluation conducted by the Government in early 2005. The CPIP follows-up the Country Procurement Assessment Review (CPAR) undertaken in 1998, which led to the preparation and implementation of the public procurement reform program. Since the 1998's review, progress has been made especially in the legal, regulatory, and institutional framework. In 2001, Parliament adopted the Public Procurement Act (PPA) that defines the rules for public procurement. The PPA complies with the international best standards with a few exceptions. The PPA created a regulatory authority, The Gambia Public Procurement Authority (GPPA), to supervise the sector. Under the leadership of GPPA; The Gambia has made slow but steady progress towards a more transparent and more efficient procurement system. As of June 2005, the International Development Association portfolio includes five projects with a total commitment of US$79 million, of which US$28.5 million is undisbursed. Country Portfolio Performance Reviews have concluded that the overall performance of the portfolio is generally weak. As a means to reduce delays in public works implementation, a number of Brazilian states have recently reformed their procurement rules allowing contractor price proposals to be assessed before the technical evaluation of submitted bids is undertaken (in a procedure known as inversao das fases). In order to evaluate the effects of such reform, this paper adopts a difference-in-differences methodology to compare the procurement performance of Sao Paulo state (a reformer state) and Minas Gerais' (a non-reformer state) largest water and sewage utility along three efficiency dimensions: (i) procurement process duration; (ii) likelihood of complaint resolution litigation; and (iii) prices paid to contractors. The analysis finds that the reform is associated with a 24 day reduction in the duration of procurement processes for large projects and a 7 percentage point drop in the likelihood of court challenges irrespective of project size. Transport infrastructure is important for economic growth. In Nepal, about 20 percent of rural residents have to spend more than 3 hours to go to the nearest marketplace or agriculture center. Public procurement is an important policy instrument to use resources wisely and efficiently. This paper analyzes a series of policy questions, from procurement design to contract management and project quality assurance. The paper finds that the competition effect is significant. To enhance competition, bidding documents can be distributed free of charge on a website. The bid preparation period can be extended. Security issues are also found to be particularly important to avoid unnecessary cost overruns and project delays. Heavy rainfall and the bidders' low-balling strategy are identified as other factors of project delays. The quality of roads would deteriorate with not only security incidence but also time, precipitation and traffic volume.

This evaluation reviews the World Bank Group's (WBG's) experience with guarantee instruments during 1990-2007. Although these instruments have been an established product line of the WBG for two decades, they have not been rigorously evaluated across the World Bank, International Finance Corporation (IFC), and Multilateral Investment Guarantee Agency (MIGA). The study asks three main questions: (1) should the WBG be in the guarantee business? (2) Have guarantee instruments in the three WBG institutions been used to their potential as reflected in WBG expectations and perceived demand? And, (3) is the WBG appropriately organized to deliver its range of guarantee products in an effective and efficient manner? The emergency nature of many of the measures taken to meet the challenges which Macedonia has faced in recent years, including the Kosovo crisis and the recent threat to the country's security, has contributed to a general laxity in the enforcement of the country's laws, including the LPP. Compliance with the procurement law has been further undermined by the absence of the institutional machinery necessary to support implementation, particularly an authoritative body to oversee enforcement and provide institutions operating under the law with guidance on its application. Whilst the Ministry of Finance (MOF) is formally charged with authority over public procurement, it is only recently that MOF has dedicated resources to perform key oversight functions. Bid evaluation is the process of selecting a contractor from a number of bidders. The decision analysis models currently in use at the Portuguese Electric Transmission Company (REN) to evaluate bids were developed through a decision conferencing process supported by the MACBETH multicriteria approach and software. This paper presents the various components of this interactive socio-technical process. Given the number of contracts awarded by REN each year, it was crucial that the models be reusable in similar calls for tenders; this required substantial care in structuring the criteria, with a focus on constructed scales, and building value function models based on qualitative pairwise comparison judgments of difference in attractiveness. Also of particular interest is the approach for weighing benefits against costs.

When a municipality contracts for goods or services, it must make use of competitive bidding / a public call for tenders for contracts over R200 000 as well as for long term contracts. A competitive bidding process generally consists of different stages, for example, compiling bid specifications, advertising the bid, the receipt and evaluation of bids, and the award and implementation of the contract. The Municipal Supply Chain Management Regulations require a municipality's Supply Chain Management Policy to provide for a committee system to oversee the different stages. Such committee system must, moreover, consist of at least a bid specification committee, a bid evaluation committee and a bid adjudication committee. Until recently, little attention has been given by the courts to the roles and composition of the different committees in the committee system. It is only after government, and in particular, municipalities have begun to implement the committee system in their procurement processes that it is evident that problems are arising. In recent months, the courts have increasingly had to deal with issues pertaining to the implementation of the committee system. In this article, the relevant legislative provisions on the committee system for competitive bids in local government are discussed. The functions of each committee are explained and all the cases that have thus far involved the implementation of the committee system are critically analysed. Much attention is given to the cases since they serve as a warning to municipalities to uphold and comply with the rules relating to the roles and composition of the different committees. The cases illustrate how important it is for municipalities to ensure that the different committees are properly constituted and that decisions at meetings are properly taken. They also highlight the importance of the supervisory role of the municipal manager over the different committees. In light of the cases it is clear that failure to comply with all the legislative requirements results in very costly litigation.
