Esta pesquisa tem como objetivo central a identificação e análise dos principais atores e temas envolvidos na internacionalização do conflito armado na Colômbia. Este estudo entende por internacionalização a participação de atores estrangeiros na formulação e/ou implementação das tentativas de resolução do referido conflito. O recorte temporal pertinente aos propósitos da pesquisa estende-se do Governo César Gaviria (1990-1994) ao final do primeiro governo de Álvaro Uribe (2002-2006), na medida em que, no período anterior, não era possível observar um envolvimento externo considerável nos processos de paz na Colômbia. Os atores selecionados para uma análise mais atenta foram: EUA e OEA, cujas agendas correspondem à proposta hemisférica predominante; e UE e ONU, as quais representam as iniciativas globais voltadas à resolução do conflito. A principal conclusão deste estudo incide sobre o agrupamento das propostas internacionais em torno desses dois pólos: hemisféricas (das quais os EUA constituem o principal expoente) e globais (que têm na UE o seu ponto focal). Esta dissertação tem por objetivo analisar as ações militares lideradas pelos EUA no Afeganistão, em 2001, como resposta aos notórios ataques terroristas de 11 de setembro daquele ano contra o WTC e o pentágono, tendo como o foco confrontar os argumentos jurídico-políticos dos EUA utilizados no sentido de qualificar suas ações militares no referido conflito armado pretensamente sob a égide da legítima defesa, com os argumentos jurídicos trazidos pelas normas, usos e costumes e doutrina do direito internacional. Na primeira parte do trabalho, são relatados, mediante a utilização da doutrina internacional, e de documentos de política externa, os fatos envolvendo o conflito armado no Afeganistão de 2001, expondo os principais acontecimentos, segundo uma ordem cronológica, abordando também as Resoluções da ONU sobre tais eventos. Dissertation submitted in partial fulfillment of the requirements for the Degree of Master of Science in Geospatial Technologies.; Despite recent methodological improvements and higher data availability, the Climate Change (CC) and Armed Conflict (AC) studies are suffering from poor data and inappropriate research designs (e.g., Incompatibilities of scale). This study fills the gaps by taking the climate conflict analyses into a different scale (e.g., 55 km x 55 km sub-national cell/year) and uses high resolution Geo-referenced data sets. This study presents the results from 10 years (1991-2000) of observations and a rigorous modelling methodology to understand the effects of climate change on the conflict occurrence in the Eastern Africa. The main objective of the study is to identify and understand the conflict dynamics, verify the pattern of conflict distribution, possible interaction between the conflict sites and the influence of climatic covariates of conflict outbreak. We have found that if the climate related anomaly increases, the probability of armed conflict outbreak also increases significantly. The surge in armed conflicts involving terrorism has brought to the fore the general question of medical care in armed conflict and the particular legal protections afforded to those providing such care to terrorists. Against this backdrop, we evaluate international humanitarian law (IHL) protections for wartime medical assistance concerning terrorists. Through that lens, we expose gaps and weaknesses in IHL. We also examine tensions between IHL and state responses to terrorism more broadly. In studying the IHL regime applicable to medical care, substantive fragmentation and gaps in legal protection between states and across types of conflict emerge. These ruptures are not new. But they are increasingly noticeable as terrorism is more frequently conceptualized as forming part of armed conflicts and as more states undertake aggressive responses to terrorist threats. The U.N. Security Council has been a key driver of these responses, requiring member states to take more and broader steps to obviate terrorist threats. Yet so far the Council has not required that, in doing so, states fully exempt impartial wartime medical care, even in circumstances that would render such care protected under IHL. Rather, the Council seems to consider providing medical assistance and supplies to al-Qaeda and its associates as at least a partial ground for designating those who facilitate such care as terrorists themselves. This thesis proposes a framework for the application of human rights treaty obligations in extraterritorial armed conflict situations. Traditionally it is International Humanitarian Law (‘IHL’) that governs the conduct of States during military operations abroad. However the humanitarian desire to increase the protections afforded by international law to individuals affected by armed conflict has gradually resulted in the recognition that International Human Rights Law (‘IHRL’) applies alongside IHL in armed conflict situations. This development is, however, associated with significant uncertainties as to the scope of the human rights obligations of States conducting military operations abroad and the relationship between IHL and IHRL in such circumstances. The aim of this thesis is to contribute to this debate by proposing a framework for a better understanding of the dual operation of IHL and IHRL when States conduct military operations abroad. States across the globe are increasingly involved in violent conflicts with non-state groups both within and across borders. This new situation challenges the classic distinction in international humanitarian law between international and non-international armed conflicts. However, the changing face of warfare does not diminish the importance of IHL. The essence of this body of law - to protect civilians and persons hors de combat and to lessen unnecessary harm during armed conflict - remains the same. The applicability of IHL must therefore be determined according to objective criteria and must not be left to the discretion of the warring parties. This article seeks to conceptualize the notion of armed conflict and examines the extent to which the existing body of humanitarian law applies to the new asymmetrical conflicts. It finds that the definition given by the ICTY Appeals Chamber in its Tadic Decision on Jurisdiction, which was taken up by Article 8(2)(f) of the Rome Statute, is a useful starting point for an analysis of the `triggering mechanism' of international humanitarian law in asymmetrical conflicts.

This is because: (1) there is no single understanding of the concepts of "cultural property" or "protection" (2) due to the principle of reciprocity, the more international an armed conflict is, the lower the chances that a treaty concerning cultural property will apply and (3) no convention has yet devised a specific safeguarding regime for "cultural heritage", which refers to the most outstanding class of cultural objects. Legal scholarship often accepts this situation, or suggests adopting a new convention to solve the field's problems. However, attempting to counteract law's failure with more laws is a nonsensical exercise that would, in the long-run, worsen the current situation. This thesis rejects law-making as an alternative and argues in a new direction. It contends that it is already possible to identify a branch of international cultural heritage law (ICHL) underpinned by a set of specific principles and a systemic objective (telos). The cross-fertilisation of such principles and telos with those of IHL provides the rationale underlying the protection of cultural property in armed conflict. Somalia's history of conflict reveals an intriguing paradox--namely, many of the factors that drive armed conflict have also played a role in managing, ending, or preventing war. For instance, clannism and clan cleavages are a source of conflict--used to divide Somalis, fuel endemic clashes over resources and power, used to mobilize militia, and make broad-based reconciliation very difficult to achieve. Most of Somalia's armed clashes since 1991 have been fought in the name of clan, often as a result of political leaders manipulating clannism for their own purposes. Yet traditional clan elders are a primary source of conflict mediation, clan-based customary law serves as the basis for negotiated settlements, and clan-based blood-payment groups serve as a deterrent to armed violence. Likewise, the central state is conventionally viewed as a potential source of rule of law and peaceful allocation of resources, but, at times in Somalia's past, it was a source of violence and predation. The armed conflict in Chiapas began in 1994 after the armed uprising of the Zapatista Army of National Liberation (EZLN). Until now the Mexican government do not recognize the existence of an armed conflict there, for what they call inter-ethnic violence that happens in different municipalities in Chiapas. This study aims at demonstrating that, first, the Mexican state of Chiapas has an armed conflict since the mid-nineties, which has intensified and transformed over sixteen years. It is in this transformation that have emerged paramilitary groups seeking to destabilize the state, generating dynamics of appropriation and control of territory through different practices such as forced displacements, selective assassinations and terror spread within populations who are the targets of their attacks (mainly community support of the Zapatista Army of National Liberation). This article reviews the evidence collected by diverse national and international organizations regarding the relationship between sexual violence against women, forced displacement, and dispossession in the context of the Colombian armed conflict. To this end, it uses the concept of “sexual violence regimes” to highlight that the endspursued by sexual violence are not always exhausted by simple consummation (that is, the act of sexual violence itself), but depending on the context, can be connected with broader strategic goals of armed actors. Este artículo presenta una revisión bibliográfica de las causas del conflicto armado colombiano. Su objetivo principal es entender por qué ha ocurrido una reducción desigual en los niveles de conflicto violento a través de las regiones del país, en el período 2003-2010. Analiza las causas económicas, institucionales y sociales, así como los debates teóricos vigentes. Se concluye que es precisamente la múltiple causalidad del fenómeno colombiano lo que lo hace tan complejo, razón por la cual los estudios encaminados a analizar la variación en el conflicto violento deben incorporar todas las variables causales y perpetuadoras del mismo.; This paper offers a review of the literature dealing with the causes of the Colombian armed conflict. Its key objective is to discuss why the reduction of the levels of the conflict-related violence was unequal in various parts of the country between 2003 and 2010. The author addresses economic, institutional, and social causes as well as embraces the ongoing theoretical debates on the issue. The paper affirms that it is precisely the diversity of the causes that makes the Colombian conflict such a complex one, and that any related study must address all of the causal variables and perpetuating factors involved.

This article is an approach to the consequences of the internal armed conflict that Colombia has lived during the last four decades. It starts with the identification of the conflict's context and its current characteristics. It then focuses on the different manifestations and consequences of the conflict and on their deep impact on the life, quality of life, health, disease, and health services of the population. In special we refer to the high homicide rates, forced internal displacement, kidnapping and the use of antipersonnel mines. Among the most affected groups are young men, women, children, and ethnic minorities such as indigenous and afro-american people. This analysis also refers to the frequent violations of International Humanitarian Law and to the negative impact of violence on the provision of health services. Finally, general conclusions are drawn, and alternatives for studies on the problem and for possible solutions from the standpoint of the health sector are proposed.

This paper reviews the literature on the theory of armed conflict and examines its application to the insurgents?? struggle with the State for political and territorial control in Colombia during 1999-2010.?? The analysis examines three sub-periods during this period and several geographic regions to analyze the effect of varying levels of participant capability on the dynamics of the conflict, as measured by the intensity of the conflict over time.?? We conclude that as long as there are asymmetries between the State and the insurgency, armed confrontation is likely to continue.; Este art??culo revisa la literatura de la teor??a del conflicto armado y examina su aplicaci??n a la lucha de los insurgentes con el Estado por el control territorial y pol??tico en Colombia durante 1999-2010. In situations of armed violence and insecurity, how do civilians influence the political environment around them? In this dissertation, I present three different studies that broadly engage this question. In concert, the papers presented herein offer new insights on civilians' relationship to armed conflict through a focus on victimization, participation, attitudes on resistance, and the effects of civilian resistance on aggregate levels of violence.

The first study explores the effects of victimization on political participation. I argue that previous answers to this question have overlooked a key variable for predicting civilian behavior: individual level social context. As a step forward in connecting social support networks to behavioral outcomes, I present the kinship network as a novel measure that captures an individual's valuable and private social interactions. I find that survivors of criminal violence with strong ties to kinship networks are most likely to attend political meetings. By highlighting variation in behavior across victims, I challenge previous work which only examines differences in participation between victims and non-victims.

This article is an approach to the consequences of the internal armed conflict that Colombia has lived during the last four decades. It starts with the identification of the conflict's context and its current characteristics. It then focuses on the different manifestations and consequences of the conflict and on their deep impact on the life, quality of life, health, disease, and health services of the population. In special we refer to the high homicide rates, forced internal displacement, kidnapping and the use of antipersonnel mines. Among the most affected groups are young men, women, children, and ethnic minorities such as indigenous and afro-american people. This analysis also refers to the frequent violations of International Humanitarian Law and to the negative impact of violence on the provision of health services. Finally, general conclusions are drawn, and alternatives for studies on the problem and for possible solutions from the standpoint of the health sector are proposed.
