Investigo nesta tese o problema da unidade épica da Tebaida a partir da hipótese de que o emprego do apelo se vincula diretamente ao andamento da ação. A metodologia consiste na teorização antiga, segundo preceitos aristotélicos e horacianos a respeito da disposição das partes e do todo em um poema, como modo de leitura do corpus e como forma de esclarecer aspectos até então não de todo estabelecidos pela fortuna crítica. Ademais, verifico quais usos do apelo nesta epopéia de Estácio se mostram ou não modelados segundo pré-figurações na Ilíada e na Eneida, assim como no Édipo e nas Fenícias senequianos. O sistema jurídico alemão é um dos mais ricos no que se refere a métodos de controle de constitucionalidade, os quais em sua maioria têm origem jurisprudencial. Diante do crescente número de casos com forte viés político, o Tribunal Constitucional Federal alemão viu-se obrigado a desenvolver técnicas que escapam à dogmática tradicional, situação que se afigura de forma análoga no Brasil. Este trabalho de conclusão de curso versa sobre uma dessas técnicas, o “apelo ao legislador”, bem como cogita da sua aplicação no direito brasileiro. Inicialmente são esboçadas as características fundamentais do controle de constitucionalidade no direito alemão. The rate of initiation and progression to dependence and premature mortality are higher for tobacco products than for any other dependence producing substance. This is not explained simply by the addictiveness (“abuse liability”) or by enticing product designs (“product appeal”) alone, but rather by both of these factors in combination with marketing and social influences that also influence “product appeal”. A working meeting of leading experts in abuse liability (AL) and product appeal was convened to examine how these disciplines could be more effectively applied to the evaluation of tobacco products for the purposes of regulation that would include setting standards for designs and contents intended to reduce the risk of initiation and dependence. It was concluded that abuse liability assessment (ALA) is a validated approach to testing pharmaceutical products but has not been extensively applied to tobacco products: such application has demonstrated feasibility, but special challenges include the diverse range of products, product complexity, and the absence of satisfactory placebo products. Certain restrictions on public funding for assisted reproductive technology (ART) are articulated and defended by recourse to a distinction between medical infertility and social infertility. We propose that underlying the prioritization of medical infertility is a vision of medicine whose proper role is to restore but not to improve upon nature. We go on to mark moral responses that speak of investments many continue to make in nature as properly an object of reverence and gratitude and therein (sometimes) a source of moral guidance. We draw on the work of Ludwig Wittgenstein in arguing for the plausibility of an appeal to nature in opposition to the charge that it must contain a logical fallacy. We also invite consideration of the moral plausibility of some appeal to nature. Finally, we examine what follows in the case of ART. Should medicine respect as natural limits that should not be overcome: the need for a man and a woman in reproduction; menopause; and even declining fertility with age? We must first ask ourselves to what degree we should defer to nature in the conduct of medicine, at least in the particular if not the general case. This will involve also asking ourselves what we think is natural and in what instances and spirit might we defy nature. Introduction: This Occasional Paper considers the need to update Victorian environmental law in connection with the law of standing and the rights of third parties to appeal the decisions of environmental regulators. Two recent events have combined to make such a consideration timely and appropriate. First, during the recent election strong commitments were made “to give Victorians a better Government by revitalising Victoria's democracy, restoring the checks and balances that keep government honest and accountable, and returning proper standards of conduct to government”. In the environmental context, it was emphasised that “[u]nderpinning Labor’s approach to conservation and the environment is a fundamental commitment to greater accountability and public scrutiny”. As discussed below, opening up the law of standing and expanding third party appeal rights would help to ensure that these important commitments are met. OBJECTIVE--To determine why most patients do not exercise their right of appeal against detention under section 2 of the Mental Health Act 1983. DESIGN--Part one--retrospective analysis of the clinical notes of patients detained under section 2 of the Mental Health Act. Part two-interviews with patients on the penultimate day before the deadline for lodging an appeal. SETTING--In part one, five districts in the Oxfordshire Regional Health Authority. In part two, six hospitals from three districts in the region. SUBJECTS--In part one all patients detained under section 2 in the five districts in 1993 (n = 418). In part two interviews with 40 patients detained under section 2 in the six hospitals. RESULTS--Patients were more likely to appeal if they were educated to A level standard (odds = 2.26; P = 0.0014) or had had a previous admission (2.19, P = 0.0029). Patients with a diagnosis of depression (0.31; P = 0.0.15) or dementia (0.0003, P = 0.0001) were less likely to appeal. Compared with those who appealed (n = 12) those who did not (n = 28) showed less understanding of their rights (P = 0.034) and poorer comprehension of sentences from the booklet describing patients' rights (P = 0.057). The main reasons given for not appealing were not being aware of the appeals process and being deterred by having to appeal in writing. We examined this concern by assessing the impact on appeal of tobacco smoking after exposure to advertisements for e-cigarettes with and without candylike flavours, i.e. bubble gum and milk chocolate. METHODS: We assigned 598 English school children (aged 11-16) to one of three different conditions corresponding to the adverts to which they were exposed: adverts for flavoured ecigarettes, adverts for non-flavoured e-cigarettes, or a control condition in which no adverts were shown. The primary endpoint was appeal of tobacco smoking. Secondary endpoints were: appeal of using e-cigarettes, susceptibility to tobacco smoking, perceived harm of tobacco, appeal of e-cigarette adverts, and interest in buying and trying e-cigarettes. RESULTS: Tobacco smokers and e-cigarette users were excluded from analyses (final sample = 471). Exposure to either set of adverts did not increase the appeal of tobacco smoking, the appeal of using e-cigarettes, or susceptibility to tobacco smoking. In consumer photography, image appeal may be defined by the interest that a picture generates when viewed by third-party observers. In this paper, the results of a ground truth experiment on human estimation of image appeal are reported, where 11 participants were asked to rank pictures in 30 groups, based on their relative appeal within their group and comment on the factors that influenced their decisions. Based on their responses, a list of both positive and negative influences was compiled and influences were grouped in general categories that include people, composition, subject, and objective metrics. The results of our experiment indicate that image appeal is related to image quality only with respect to the influences in the category of objective metrics, while the majority of influences belong to the categories of people, composition, and subject. The influences in these categories are scene dependent and fundamentally different in nature from traditional image quality metrics. A majority of Deaf Americans agree that viewing a typical theatrical performance is a formidable task. In the second half of this century, attitudinal changes made by Americans have resulted in new and increased opportunities for their Deaf counterparts to participate in American theatre. American theatregoers who are Deaf can choose plays in general theatre as well as those in Deaf theatre. However, they experience problems in appreciating plays in Deaf theatre. More specifically, audience appeal is the main problem. Audience appeal refers to a concept in which major aspects of performances are designed to engage the thoughts and reactions of a group of spectators. Its definition is slightly expanded for playgoers who are Deaf; the aspects of performances are generally designed to that they play on human visual capacities. Essential characteristics of audience appeal for Deaf audiences consist of adding sign language principles and conventions from Deaf culture. The Labour Appeal Court in Kylie v CCMA decided the vexed question as to whether or not the CCMA has jurisdiction to resolve a dispute of unfair dismissal involving a sex worker. Both the CCMA and the Labour Court had declined to assume jurisdiction to resolve the dispute on the basis that the employee's contract of employment was invalid and therefore unenforceable in law. The Labour Appeal Court, on the other hand, overturned the Labour Court's decision and held that the CCMA has jurisdiction to resolve the dispute, regardless of the fact that sex work is still illegal under the South African law. For this decision, the Labour Appeal Court relied on section 23(1) of the Constitution, which provides that everyone has the right to fair labour practices. According to the Labour Appeal Court the crucial question for determination by the court was if a person in the position of a sex worker enjoyed the full range of constitutional rights including the right to fair labour practices. In the court's reasoning the word everyone in section 23(1) of the Constitution is a term of general import and conveys precisely what it means. Cigarette smoking continues to pose a global health risk, including in developing countries. Fear appeal messages have been widely employed in health communication to reduce cigarette smoking, but studies provide conflicting results on their efficacy. The present qualitative study explores smokers' perceptions of fear appeal messages used in anti-smoking advertising. Focus group discussions were conducted with male and female smokers from Gauteng. A thematic analysis found that participants negatively viewed advertisements that use unrealistic images and failed to relate to the message portrayed. Information about the risks associated with smoking was perceived as patronising and as positioning smokers as ignorant and unintelligent. In addition, fear appeal messages that only focus on long-term consequences of smoking were perceived as ineffective. Participants failed to identify with content that solely relied on factual information at the expense of an emotive appeal. The findings suggest that anti-smoking communication could benefit from content that evokes shock without sacrificing realism, that it should include information about shortterm and immediately visible consequences of smoking and that it should avoid negative depictions of smokers that alienate them from the message being portrayed.
