This exploratory study, with the aim of bringing mediation and arbitration - which have been so far mainly discussed under the legal point of view - to the context of business management, tries to identify up to which point these services can be recognized as a valid alternative to manage conflicts in the inter-organizational strategic relationships. This kind of relationship is present in strategic alliances, joint ventures and in existing supply chains and distributions channels¿ partnerships. Analyzing the theoretical reference framework three knowledge areas were associated and integrated: conflict management and negotiation; mediation and arbitration, as the most common Alternative Dispute Resolutions-ADRs; and strategic alliances, supply chains and distribution channels. This review of literature and documents was complemented with a research among two target groups: the potential consumers of mediation and arbitration services in the organizational field; and the potential suppliers for those services. O presente trabalho tem como objecto a análise da implementação dos processos alternativos de resolução de litígios e o concomitante fenómeno da descentralização da administração da justiça no sistema judicial português. É composto por duas partes distintas. Uma primeira onde se apresenta o enquadramento teórico a partir do qual se inicia a investigação e uma segunda, de cariz prático, que se traduz na análise das tentativas de implementação das soluções reformadoras da administração da justiça através de processos e concepções onde imperam valores diferentes dos propostos pelo modelo tradicional de administração da justiça. This thesis is about arbitration, a form of alternative dispute resolution, as a solution for the slowness of the Brazilian Judiciary. The paper starts with an approach of the fundamental rights, highlighting their positivation, important to distinguish them from human rights, the four dimensions of the fundamental rights and, lastly, the analysis of their features, emphasizing their characters of complementarity and universality. After, it starts to discourse about the “access to Justice”, an important fundamental right, and, to delimitate the role of the Judiciary and the problems related to solve cases in a reasonable amount of time. Next, it exposes other alternative forms of dispute resolutions that, like the arbitration, can help to the concretization of a faster and more effective Justice. Then, it discusses the historical evolution of the arbitration in Brazil, highlighting the contemporary features of the institute, which were more visible with the ratification of the New York Convention and the promulgation of Law nº 9.307/1996. This report assesses Thailand s corporate governance policy framework. It highlights recent improvements in corporate governance (CG) regulation, makes policy recommendations, and provides investors with a benchmark against which to measure corporate governance in Thailand. It is an update of the 2005 Corporate Governance Report on the Observance of Standards and Codes (CG ROSC). Good corporate governance enhances investor trust, protects minority shareholders, and encourages better decision making and improved relations with workers, creditors, and other stakeholders. Better investor protection can lower the cost of capital and encourage companies to list and raise funds through equity markets. It is crucial to protect retirement savings invested in listed companies. Good corporate governance also helps to ensure that these companies operate more transparently and efficiently.

Approved for public release, distribution unlimited; MBA Professional Report; This project examines bid protest prevention and resolution strategies to shed light on ways to save the government money and time. Successful resolutions of protests depends on a number of factors, including government and private sector protest management and litigation strategies; Alternate Dispute Resolution (ADR) policies of federal agencies; legal and regulatory requirements; and remedies available to contractors. Our research identifies and analyzes best ADR practices and other remedies and preventions for resolving bid protests. Areas examined include processes and remedies utilized by selected federal agencies and obstacles to fomenting improved cooperation between industry and government, which may preclude win-win resolutions to bid protests. Insights regarding the validity of our entering hypotheses about ADR are obtained from a survey of acquisition and legal professionals regarding their perceptions, opinions, and recommendations on bid protest practices and the use of ADR procedures. The Baseline Indicators (BLIs) assessment has been conducted by the Development Partners and the Government of Pakistan as a precursor to carrying forward the Government's efforts to upgrade the Country Procurement Systems (CPS) to international standards and to help it assess the level and type of technical assistance required for achieving this objective. The assessment, being the first phase of a comprehensive procurement performance assessment, covered the four pillars as well as all the indicators and sub-indicators in each pillar based on a review of the existing regulatory framework and the institutional and operational arrangements and as provided for in the Organization for Economic Development (OECD) Development Advisory Committee (DAC) guidelines. Esta dissertação investiga a relação entre eficiência econômica e reclamações trabalhistas. Especificamente, neste trabalho desenvolvemos um modelo teórico baseado na Teoria dos Jogos que explica o funcionamento econômico dos casos de reclamações trabalhistas, com ênfase na escolha entre soluções negociadas ou litigiosas para as mesmas. O texto dá atenção especial ao sistema existente no Brasil das Câmaras de Conciliação Prévia. Também testamos empiricamente as conclusões teóricas do modelo, para obter apoio empírico às suas previsões.
