O Código Sanitário Municipal de Alimentos, Decreto Municipal n°25.544, de 14 de março de 1988, regulamentou a fiscalização sanitária de gêneros alimentícios no varejo até 26 de novembro de 2002, data em que entrou em vigor a Lei Estadual n° 10.083, de 23 de setembro de 1998, Código Sanitário do Estado de São Paulo, utilizado pelos serviços municipais de vigilância, em caráter temporário, até a promulgação do Código Sanitário do Município de São Paulo. Em 9 de janeiro de 2004, entrou em vigor a Lei Municipal n° 13.725, Código Sanitário do Município de São Paulo, regulamentando todos os serviços e produtos de interesse da saúde, inclusive a produção e distribuição de alimentos e água para consumo humano. A comparação entre os Códigos de 1988 e de 2004 permitiu a identificação das mudanças ocorridas na legislação e nos procedimentos administrativos da vigilância sanitária do varejo de alimentos no Município de São Paulo. Essa dissertação versa sobre o processo administrativo do Cade a partir de uma visão instrumentalista que leva em conta a regulação da concorrência exercida pelo Conselho. O seu objetivo é delinear as particularidades do processo administrativo concorrencial brasileiro e seu regime legal. Para tanto, estabelece: (i) as características da função exercida pelo Cade; (ii) o regime jurídico ao qual se submete o Cade; (iii) as limitações da doutrina de processo administrativo para tratar do tema; (iv) uma proposta de abordagem para o tratamento de questões de processo administrativo que trás para o primeiro plano a consideração das particularidades dos processos específicos e implica também na reflexão sobre uma teoria geral dos processos; e (v) as características básicas dos três vetores que constituem o cerne dessa teoria geral e da própria noção de processo (permeabilidade, funcionalidade e moralidade). Redress procedures are important for basic fairness. In addition, they can help address principal-agent problems in the implementation of social policies and provide information to policy makers regarding policy design. To function effectively, a system of redress requires a well-designed and inter-linked supply of redress procedures as well as, especially if rights consciousness is not well-developed in a society, a set of organizations that stimulate and aggregate demand for redress. On the supply side, this paper identifies three kinds of redress procedures: administrative venues within government agencies, independent institutions outside government departments, and courts. On the demand side, the key institutions are nongovernmental organizations/civil society organizations and the news media, both of which require a receptive political and economic climate to function effectively. The Pan-Arab Free Trade Area, negotiated under auspices of the Arab League, came into force in 1997. Under the agreement all tariffs on goods of Arab origin were to be removed by January 1, 2005. This paper summarizes the results of a firm-level survey in nine countries regarding the implementation of the Pan-Arab Free Trade Area. A majority of respondent companies report that tariffs on intra-regional trade have largely been removed, and that there has been a marked improvement in customs clearance-related procedures. Costs associated with administrative red tape and weaknesses in transport-related infrastructure services are ranked as the most important constraints to intra-regional trade. This suggests that from a policy perspective, efforts to reduce real trade costs deserve priority, including transportation and logistics services. Periodic monitoring and assessment of trade incentives and performance would help governments to benchmark performance and identify priority areas for action, at both the national and the sub-regional levels.

In many developing and middle-income countries, decentralization reforms are promoting changes in governance structures that are reshaping the relationship between local governments and citizens. The success of these decentralization reforms depends on the existence of sound public financial systems both at the central and local levels. This paper focuses on the role of budgeting as a critical tool in reform efforts, highlighting problems that might impede successful local government budget development and implementation. The attainment of effective local government accountability and transparency is not an end itself, but rather it represents the means to support better decision-making on national and local budgeting. Community based schemes for enhancing local government accountability need to combine legal, political, and administrative mechanisms with proactive community involvement. Of particular importance are the legal and budgetary instruments that require input from local community members on certain local government decisions and instruments that increase accessibility for the press or the general public at large to information on government activities.

The results of the alpha survey on administrative barriers completed in 2006 indicate that, notwithstanding recent government reforms to reduce regulations affecting firms, administrative burdens are still substantial impediments to doing business. Based on the survey, the Bulgarian Government has commissioned an in-depth analysis of the procedure affecting three sectors: tourism, food, and transport. This report recommends the efficiency of inspections should be evaluated and a centralized inspection authority for foodstuffs and feed should be considered. The book consists of two papers which provide an overview of administrative barriers in Africa, and a very in-depth look at how one country, Mozambique, used a very large foreign investment as a mechanism to begin to tear them down. The first paper is based on a series of country-specific studies on administrative barriers done by Foreign Investment Advisory Service (FIAS) and the United States Agency for International Development. These studies covered Ghana, Mozambique, Namibia, Tanzania, and Uganda. Each country study relied on review of primary materials, laws, and regulations. The second paper is a detailed look at how the administrative barriers that existed in Mozambique threatened to derail the huge Mozal aluminum smelter that was proposed by South African investors. Not only were the barriers overcome for this special project but also the Government used the knowledge gained in the process to reduce barriers for all investors and establish institutions that could facilitate other investments. The message in both papers is that administrative barriers constitute a significant impediment to foreign direct investment in Africa. Many of the administrative procedures required of investors have no real justification. Removal of unnecessary barriers and streamlining other administrative procedures require detailed efforts by governments involving the exercise of significant political leadership.

Building upon the transport governance filter developed by the Europe and Central Asia (ECA) transport team, which identified several thematic principles and actionable indicators on the governance of the transport sector at large, this paper seeks to assess the overall governance performance of the road sector as well as the concrete issues that road administrations should address in order to improve sector governance. A pilot survey was conducted in Armenia and Kazakhstan, in which road sector stakeholders were asked to evaluate more than seventy questions structured along four governance dimensions: (i) transparency, disclosure and accountability of the road agency; (ii) transparent and accessible procurement processes; (iii) financial management system; and (iv) administrative procedures and anticorruption effort. The legal provisions for ordinary naturalisation determine which foreign residents may apply for naturalisation. However, these legal provisions are not the only opportunities and obstacles that immigrants face on the path to citizenship. Administrative procedures are crucially important for the implementation of these legal provisions and guarantee access in practice. Based on existing literature on the implementation of naturalisation policies, the ACIT project calculated 38 ‘Implementation Indicators’ (CITIMP), which measure the formal steps of the ordinary naturalisation procedures in 35 European countries. The CITIMP results suggest that most countries’ procedures contain as many obstacles as opportunities for ordinary naturalisation with many clear patterns across Europe. Promotional measures are often missing or poor quality. Legal exemptions for documentation rarely exist on humanitarian or vulnerability grounds. Documentation from countries of origin is especially complicated for applicants. Not only are most ordinary naturalisation procedures discretionary, but so are many language, integration and economic resource requirements. Recent international experience has shown that excessively complex administrative procedures, required to establish, and operate a business, discourage inflows of foreign direct investment. The authors present a new database on the administrative costs faced by private investors in 32 developing countries. The database is much more comprehensive than the existing sources, as it contains not only information on general entry procedures, such as business and tax registration, but also captures regulation on land access, site development, import procedures, and inspections, The data include measures on the number of procedures, direct monetary costs, and time. The cost of administrative procedures vary significantly across countries. The present report on the Administrative and Regulatory Barriers to Business is part of an ongoing World Bank analytical and advisory support to the Government of Bulgaria in the area of regulatory reform. As an alternative to traditional subsidy schemes in utility sectors, direct subsidy programs have several advantages: they are transparent, they are explicit, and they minimize distortions of the behavior of both the utility, and the customers. At the same time, defining practical eligibility criteria for direct subsidy schemes is difficult, and identifying eligible households may entail substantial administrative costs. The authors, using a case study from Panama, discuss some of the issues associated with the design of direct subsidy systems for water services. The conclude that: 1) There is a need to assess - rather than assume - the need for a subsidy. A key test of affordability, and thus of the need for a subsidy, is to compare the cost of the service, with some measure of household willingness to pay. 2) The initial assessment must consider the affordability of connection costs as well as the affordability of the service itself. Connection costs may be prohibitive for poor households with no credit, suggesting a need to focus subsidies on providing access, rather than ongoing water consumption. 3) A key issue in designing a direct subsidy scheme is its targeting properties.
