Este trabalho visa a realizar uma análise sistemática das diversas normas do Código de Processo Civil que tratam do abuso de situações jurídicas processuais. O tratamento desse tema é dividido em quatro partes. Em primeiro lugar, analisa-se a teoria geral do abuso do processo, que abrange a evolução histórica do abuso processual, a adoção da teoria do abuso do direito oriunda do Direito privado, os fundamentos da prevenção e da repressão dos comportamentos abusivos, os elementos essenciais que caracterizam o abuso do processo (objeto, sujeitos e requisitos do ato processual abusivo) e a discussão acerca da ilicitude do ato processual abusivo. Abuse of the elderly is a form of violence to come to the public’s attention. Dental professionals are in an ideal position to identify physical abuse. The aim of this study was to assess the prevalence of elderly abuse and analyze the database of injury reports that can be identified by dental teams. A documentary analysis study developed by the Elderly Protection Police Station of Porto Alegre, Rio Grande do Sul, was carried out. The information used came from 2,304 complaints filed at the aforementioned institution between the years of 2004 and 2006. The records of abuse are categorized as injury, neglect, mistreatment, theft, financial abuse, threat, disturbing the peace, atypical fact, and others. The injuries that could be identified by the dental team were classified according to the injury’s location in the area of the head, face, mouth and neck. Descriptive analysis was performed, and chi-square tests were used to evaluate the distributions of the types of elder abuse in relation to sex and age. The most frequent of the different types of abuse was theft, with a prevalence of 17.8%, followed by disturbing the peace at 11.8%. O objetivo deste trabalho foi avaliar as complicações do tratamento de fraturas mandibulares, em pacientes com consumo de substâncias nocivas à saúde, atendidos pela Área de Cirurgia Buco-Maxilo-Facial da Faculdade de Odontologia de Piracicaba - Unicamp, no período de abril de 1999 a março de 2004, comparando sua relação com diversos fatores epidemiológicos, dados obtidos através dos prontuários pertencentes ao arquivo da área. Para a realização desta pesquisa foram agrupados os pacientes segundo o tipo de substância consumida, os resultados obtidos definiram cinco grupos específicos: pacientes sem vícios, pacientes fumantes, pacientes que abusam no consumo de álcool, pacientes consumidores de drogas não endovenosas e pacientes consumidoresde drogas endovenosas. Objective: The study examines the self-reported prevalence of childhood physical and sexual abuse in a large sample of Portuguese parents. Method: Nearly 1,000 parents (506 mothers and 426 fathers) were selected through public primary schools from the Northern area of Portugal. All completed the Portuguese version of the Childhood History Questionnaire (CHQ) [Journal of Family Violence 5 (1990) 15]. Results: Results show that the prevalence of abuse was 73%, but more severe physical abuse involving seque- lae/injury was reported by 9.5%. Most physical abuses began prior to age 13, with half continuing after age 13. No gender differences were found for rates of physical abuse. However, among the milder physical abuse without sequelae/injury, those women who experienced “whipping” or “slapping/kicking” were more likely to do so from their mothers than fathers. Among men who were “slapped/kicked” this was more likely to be from their fathers. Low rates of sexual abuse were found at 2.6% with no gender or age differences. Lack of a supportive adult in childhood related to the more severe abuses, but only in adolescence. The purpose of this paper is to identify, describe and compare the studies of the prevalence of abuse and neglect of older adults developed in Portugal. Design/methodology/approach – A retrospective bibliographic search of seven descriptors in English and Portuguese, of academic and professional papers and university institutional repositories was performed. Findings – Of the nine studies selected, seven consisted of grey literature – research developed within the course of academic post-graduate studies. The studies were conducted on a small scale, more often than not, through a non-probabilistic convenience sampling method. From the nine studies, two instruments prevailed: the Questions to Elicit Elder Abuse aimed at older adults and the Caregiver Abuse Screen aimed at caregivers. Community-dwelling older adults self-reported a higher prevalence of abuse (between 66.7 and 86.7 per cent) than care professionals working with older adults suffering from dementia (between 26.7 and 47.4 per cent). Emotional abuse and neglect were the first and second most prevalent forms of abuse, followed by financial abuse, whereas physical abuse was the least prevalent type of abuse encountered. This monograph is based on the papers from a technical review on “Inhalant Abuse” held in 1989. From: Inhalant Abuse: A Volatile Research Agenda. Editors: Charles Wm. Sharp, Ph.D., Fred Beauvais, Ph.D., and Richard Spence, Ph.D. NIDA Research Monograph 129, 1992; Inhalant abuse is arguably the most toxic of all substance abuse practices. Consequently, as discussed by several conference participants, biomedical research has focused on the adverse consequences of this form of substance abuse, particularly for the nervous and other organ systems. Such work is of interest not only because of its relevance to inhalant abuse, but also because it contributes to understanding occupational and environmental health problems, and to a basic understanding of the nervous system and its pathophysiology. Identification of the sequelae of inhalant abuse guides one only in the prevention and treatment of organ toxicity; it adds little guidance to prevent the substance abuse practice itself. If society can devise strategies for preventing inhalant abuse, by definition this will prevent not only solvent-induced organ system toxicity, but also the displacement of socially productive activities. Introduction: Maltreatment and abuse of children have been considered a problematic of modern societies essencially because there is a greater exposure of the subject. Therefore, health professionals, particularly nurses have come to pay heed to this issue in order to prevent, detect, signal, track and route the mistreatment and abuse of children.Knowledge about the determinants that lead to the onset of mistreatment and abuse of children is crucial to the development of health interventions in this target group particularly through partnerships with schools.The objectives of this work focus on characterize the victims of mistreatment and abuse and also identify and analyze which are the determinants of ill-treatment and abuse. Methods: Integrative literature review, in which eight articles (in Portuguese, English or Spanish) were selected and analyzed from recognized published data bases, with a time limit of ten years. El objeto de este Trabajo Fin de Grado (TFG) es evaluar el nivel de conocimientos que posee y maneja el profesional docente en las etapas de Educación Infantil y Educación Primaria sobre el maltrato infantil. Esto facilitaría poder llevar a cabo de forma efectiva la detección y posterior notificación de posibles casos desde su ámbito de actuación, el ámbito educativo. La metodología de investigación se centra en el diseño de un cuestionario sobre los conocimientos acerca del maltrato infantil y su detección en la escuela, así como su posterior aplicación en cinco colegios de una localidad del norte de España. Proposals for the application of Bayes’ Theorem as an aid to child abuse decision making are discussed critically. Subsequently, two examples of the application of research findings concerning signs of child abuse to decision making are demonstrated, using data from research studies of signs of physical abuse and sexual abuse. The calculation of the probability of the presence of abuse using Bayes’ Theorem is described, given prevalence information and specific indicators of abuse. In addition, a method for describing the degree of imprecision in estimates of the probability of abuse is discussed. Specific issues that affect the valid application of research findings within Bayes’ Theorem are discussed, including estimates of the prevalence or base rate of child abuse, sensitivity and specificity of diagnostic signs, and the independence of information that is combined in Bayes’ Theorem. Recommendations for addressing these issues when Bayes’ Theorem is applied to child abuse decision making are discussed, including assessment of the independence of indicators that are combined in Bayes’ Theorem, suitable bases for estimating the prevalence of abuse, and the calculation of imprecision in probability estimates of abuse.; Michael Proeve

Intergenerational associations between a consensual childhood sexual experience and adult substance abuse among Latina mothers and daughters

Purpose: Early onset of sexual activity has been linked to later substance abuse. Our study aimed to further describe the associations between Latina mothers’ and daughters’ early sexual activity and adult substance abuse. Methods: A survey was conducted with 92 Latina mother–daughter dyads whose members never experienced sexual abuse. Childhood sexual experience was defined as the occurrence of a consensual sexual encounter at the age of 15 years or younger. Substance abusers were identified by the extent of substance use during the 12 months prior to the interview. Path analysis was used to fit our conceptual models to the data. Main findings: Daughters’ current, adult substance abuse was associated independently with: their own childhood sexual experience (odds ratio [OR] = 6.0) and mothers’ current, adult substance abuse (OR = 2.0). Compared with daughters who first experienced sex after the age of 19, the odds of using substances were 17.7 times higher among daughters who had childhood sexual experience and 3.8 times higher among daughters who first experienced sex between the age of 16–19 years. Explicitly, sexual experiences between the ages of 16–19 years were also risk factors for later adult substance abuse. Mothers’ childhood sexual experience (OR = 7.3) was a strong predictor for daughters’ childhood sexual experience. Introduction • The study included women aged between 60 and 97 years who were living in private households. The survey asked about violence and abuse in the last 12 months. 2880 women were surveyed across five countries during 2010. • So-called “stranger violence” was ruled out and only perpetrators who were in the women's close circles were considered. • Response rates ranged from 26.1% (Belgium) to 49.1% (Austria). Purpose. The purpose of this study was to assess the psychometric properties of the Burgess-Partner Abuse Scale for Teens (B-PAST) by examining internal consistency and construct validity.Methods. A convenience sample of 239 teen girls ages 13 to 19 years old that were seen in three private primary health care practices agreed to participate. Subjects were administered two measures of interpersonal violence, two measures of psychosocial well-being, and a demographic questionnaire. Construct validity was assessed by 1) conducting exploratory factor analysis with a priori decision to retain two factors, and 2) measuring differential correlates of interpersonal violence and psychosocial well-being using Pearson correlation. In order to determine the instrument's ability to discriminate between teen girls who reported partner abuse and those who did not report partner abuse, differences in contrasted group means (abused vs. non-abused) were examined. One-way ANOVA was used to determine differences in interpersonal violence and psychosocial wellbeing. The internal consistency of the B-PAST was examined by setting a criterion for the alpha coefficient above .70.Results. The results showed that 70.9% of the variance was explained by the B-PAST. ResumenEl abuso físico y el abuso psicológico representan un problema de salud pública frecuente en mujeres colombianas. No obstante, pocas investigaciones exploran las variables asociadas en mujeres adultas. Objetivo: establecer variables psicosociales asociadas a abuso físico y psicológico en mujeres de Bogotá (Colombia). Materiales y métodos: se diseñó un estudio analítico transversal. Se solicitó la participación de mujeres adultas con pareja de estrato socioeconómico bajo. Se aplicaron las escalas: Apgar familiar (disfunción familiar), Escala de Rosenberg (autoestima), Cuestionario General de Salud (GHQ-12, trastornos mentales comunes) e Índice de Abuso a la Pareja (Index of Spouse Abuse, ISA-8, ISA-F e ISA-P). Mediante regresión logística se ajustaron la variables psicosociales asociadas al abuso físico y al abuso psicológico. Resultados: participaron 292 mujeres. La media para la edad fue 33,0 años (DE = 9,23). Introduction: HIV-related stigma and discrimination and disrespect and abuse during childbirth are barriers to use of essential maternal and HIV health services. Greater understanding of the relationship between HIV status and disrespect and abuse during childbirth is required to design interventions to promote women's rights and to increase uptake of and retention in health services; however, few comparative studies of women living with HIV (WLWH) and HIV-negative women exist. Methods: Mixed methods included interviews with postpartum women (n = 2000), direct observation during childbirth (n = 208), structured questionnaires (n = 50), and in-depth interviews (n = 18) with health care providers. Bivariate and multivariate regressions analyzed associations between HIV status and disrespect and abuse, whereas questionnaires and in-depth interviews provided insight into how provider attitudes and workplace culture influence practice. Results: Of the WLWH and HIV-negative women, 12.2% and 15.0% reported experiencing disrespect and abuse during childbirth (P = 0.37), respectively. Background: Over one million people have HIV infection in the United States (U.S.), where HIV has permeated all regions of the nation and all ethnic and racial groups. HIV transmission occurs through a number of mechanisms, many of which can be exacerbated by substance use. In 2008, nearly one in four of the HIV-positive population was in need of substance use treatment. The lives of HIV-positive substance users can be further complicated by histories of sexual and physical abuse which is related to worse overall health, health behaviors, and health outcomes.

Objective: This study explores the relationship between the age of initiation of abuse, the type of abuse, psychological symptoms that may result from abusive events, and the confidence in one's ability to communicate with a health care provider, get support from family and friends, and manage his or her mood.

Methods: In the current study, 206 HIV-positive patients were recruited from three infectious disease clinics. The participants screened positive for alcohol or substance use and, as part of a larger study, consented to twelve months of integrated HIV-substance use treatment. CONTEXTO: Muitos transtornos psiquiátricos, geralmente diagnosticados pela primeira vez na infância, estão associados a maus-tratos, entre eles o abuso físico, causando significativo impacto no desenvolvimento das crianças acometidas. OBJETIVOS: Avaliar a associação entre um diagnóstico psiquiátrico do grupo dos transtornos de déficit de atenção e do comportamento disruptivo (TDACD) em crianças e a história de abuso físico na infância. MÉTODOS: Em um estudo seccional, crianças de 3 a 12 anos, atendidas em um ambulatório de psiquiatria de um hospital universitário, foram avaliadas por meio do MINI KID (), tendo sido diagnosticadas de acordo com os critérios do DSM-IV. A avaliação de abuso físico e de outros eventos traumáticos foi realizada por um questionário específico, o LSC-R () e inclui diferentes tipos de maus-tratos. RESULTADOS: Encontrou-se uma razão de chance mais alta de exposição freqüente ao abuso físico (p = 0,02) no grupo de crianças diagnosticadas com TDACD. Não se encontrou associação entre transtornos de humor (p = 0,67) e de ansiedade (p = 0,57) com abuso físico. This article investigates the relationship between sexual abuse, power and the body from a Catholic theological viewpoint. The article starts with the relationship between sexual abuse and power. It is argued that sexual abuse is always a form of power abuse. A second step examines the relation between sexual abuse and the body. We may not ignore the theme of the body when we speak about sexual abuse as a form of power abuse. The article also explores whether the body is a theme in recent (theological and popular) literature on sexual abuse. It discusses how the perception of the body has an impact on dealing with the body and potential sexual abuse. The article concludes with a search for an appropriate image of the body that may reduce the prevalence of sexual abuse.

OBJECTIVE: To assess the prevalence of child abuse among high school students in Curaçao. METHODS: A questionnaire survey among high school students up to 17 years of age was conducted. The questionnaire was based on existing literature and validated questionnaires. The questionnaire used was analysed and adapted to the situation in Curaçao by a panel of experts on child abuse. The primary objective was to gain insight into the incidence, prevalence and various forms of child abuse among students in Curaçao. Five forms of child abuse are distinguished in the literature: physical abuse, emotional abuse, sexual abuse, neglect and exploitation. Furthermore, the degree of confidence of the students in general practitioners (GPs) as care providers in the field of child abuse was explored. RESULTS: Questionnaires from 545 of the 628 respondents were included. In total, 43% of the respondents had ever-experienced an event which could be defined as (a form of) child abuse. More than one-third of the respondents reporting child abuse ever had an experience that could be interpreted as physical abuse. More than 15% of the respondents reporting child abuse had experienced sexual abuse. Girls experienced significantly more sexual abuse than boys.
